A few days ago, we reported that the National Health Fund questioned services worth PLN 5 156 421.96 at the hospital in Bolesławiec and additionally imposed PLN 742 255.09 in contractual penalties. The total financial consequence of the NFZ findings therefore amounts to PLN 5 898 677.05.

Director of St. Luke’s Hospital Kamil Barczyk had already told istotne.pl that the facility had appealed against the Fund’s findings. Now, in a conversation with our editorial team, he said that NFZ had rejected the appeal. “We naturally appealed against it. NFZ rejected the appeal,” said Kamil Barczyk.

Dispute over how services were settled

According to the director, the questioned services were provided במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת במסגרת ramach ambulatory specialist care in several clinics. Barczyk explains that the dispute between the hospital and NFZ does not concern whether patients received services, but how they were settled.

“NFZ believes they should have been settled under a different billing group, meaning that the value of these services should be lower,” the director explained. As he emphasized, the provision of the services themselves was confirmed during the inspection. “The services were provided; this was confirmed,” he said.

According to the hospital management’s position, this would mean that the fundamental difference between the parties concerns the amount payable for the procedures performed.

Barczyk: final amount could be many times lower

The hospital will now reanalyze the questioned services and resettle them according to the rules adopted by NFZ. The director expects that only after this process will it be possible to determine the actual amount the facility will have to repay to the Fund.

“The final amount payable to NFZ will probably be many times lower than five million,” said Kamil Barczyk. He did not provide a specific sum, however. At this stage, it is therefore not known exactly how much the hospital would ultimately have to repay.

The contractual penalty of more than PLN 742,000 remains a separate issue.

Hospital considers court action

After NFZ rejected the appeal, the hospital is analyzing the possibility of further challenging the Fund’s findings.

“The next procedure is our analysis and, potentially, court proceedings, because this concerns interpretation—how doctors and the team responsible for settlements classify these services,” Barczyk said. The director indicated that the possibility of going to court would be analyzed primarily in relation to the penalty imposed. “The penalty is, in fact, the factor that will currently be pursued and analyzed in terms of a possible court case,” he stated.

NFZ: more than PLN 5.1 million in funds transferred without entitlement

The position presented by NFZ to the editorial team earlier is more unequivocal. The Fund reported that the inspection found irregularities in ambulatory specialist care.

“The irregularities identified in ambulatory specialist care resulted in the hospital being sanctioned for funds transferred without entitlement, amounting to PLN 5 156 421.96, as well as contractual penalties of PLN 742 255.09,” Paulina Deksymer of the Lower Silesian Voivodeship NFZ Branch told us.

The Fund therefore classified more than PLN 5.15 million as funds transferred without entitlement. Hospital management, meanwhile, maintains that the services were indeed provided and that the dispute comes down to the billing group applied and the resulting valuation.

More than PLN 20 million from last year awaiting settlement

In a conversation with istotne.pl, Kamil Barczyk also drew attention to money which, according to the hospital, NFZ has still not settled for services provided by the facility.

As he said, the issue concerns more than PLN 20 million in services exceeding the contracted limits last year. “At the moment, for last year, there are several dozen million złoty in unsettled and unpaid services,” he said. According to the director, they concern practically all hospital departments. The facility is waiting for NFZ to open the possibility of settling them.

According to Barczyk, the hospital generated an even larger amount in the first half of this year. “This year, the amount is nearly PLN 70 million through the middle of the year,” he said. The director hopes that NFZ will begin paying at least part of the amounts due for services exceeding the contracted limits.

One issue still requires clarification

In the conversation, Kamil Barczyk said that the inspection “took place in 2023–2024.” In information previously provided to our editorial team, NFZ stated that the inspection proceedings covered selected services provided from January 1 to December 31, 2024.

We will therefore clarify with the Fund the exact period covered by the findings, as well as ask about the consequences of the hospital’s rejected appeal and what portion of the more than PLN 5.15 million could be adjusted after the services are recalculated.
