The court presented the testimony of a senior master, the manager of the cemetery under MZGK administration, and the person who trained the injured woman for work in the office. The witness was absent due to hospitalization.
The woman’s testimony indicated that, under Dariusz F.’s management, cemetery employees were not treated well by the defendant. The woman’s testimony confirmed the allegations made against the defendant by the injured woman.
Dariusz F. gives extensive explanations concerning the circumstances in which he employed the injured woman at the cemetery in 2017.
The councillor denies that he helped his family by employing relatives at the cemetery. He said that he had helped around 10 unrelated people in this way.
The councillor also reveals the circumstances surrounding his employment as cemetery manager, as well as the difficult interactions between him and the employees during shifts and the company’s restructuring in 2017.
– I waited three years to give this explanation before the court, said councillor Dariusz F. – In May 2018, Ewa P.’s hiring coincided with the implementation of GDPR regulations at the company. Ewa P. did make mistakes in protecting these regulations. As manager, implementing GDPR was among my duties. It is not true that I shouted at Ewa P. Why would I want to dismiss someone whom I myself had recommended for the position? asked the former cemetery manager.

Dariusz F., deeply emotional and crying, concluded his more than two-hour statement in court.
– I will never come to terms with what happened, said councillor Dariusz F. – What was done to me is disgraceful. They made a “bully” out of me, while this woman (the injured party—the editor) became the persecuted one. Did I employ her in order to persecute her? the defendant asked rhetorically.
Darisuz F. was moved to tears when he accused the press of bias in its reporting on workplace harassment at MZGM. He suggested that articles about him had caused illness in him and his wife, and even his mother’s death.
The former cemetery manager also said that his dismissal from the cemetery had been planned. However, he was unable to say who had planned it or why they wanted to remove him from his position.
The injured woman responded to Dariusz F.’s statements.
– What happened to the defendant took place over a period of time, said the injured woman. – What he learned about himself from the media, the employees and me was the truth about himself. Because he refused to accept what kind of person he was, the injured woman added.
Let us recall that in December 2020, a penalty order (that is, one issued on the basis of the case files) was handed down in the case against councillor Dariusz F. Investigators accused him of abusing an employee and inciting the commission of the crime of forging a signature. Both offences carry a penalty of between three months and five years in prison. At that time, the Bolesławiec court sentenced Dariusz F. to:
- a fine of PLN 8,000
- PLN 10,000 in compensation for the injured party
- a two-year restraining order against the injured party
In the prosecution’s view, the sentence against Dariusz F. should be harsher. According to the investigators, the issue of a ban on holding managerial positions also requires consideration. Sebastian Woźniak, deputy head of the District Prosecutor’s Office in Bolesławiec, Sebastian Woźniak filed an objection to the court’s judgment.
