We asked Spółdzielnia Mieszkaniowa „Bolesławianka” about the car on Parkowa. The cooperative explained:
The road at 2–6 Parkowa has the status of a private (internal) road, jointly owned by the property owners, including the cooperative. The lack of designation as a traffic zone significantly limits the ability of the services and the property manager to intervene or take action. The cooperative is not authorized to remove the vehicle independently, while determining the vehicle owner's identity—if the owner does not come forward—is a time-consuming and formalized procedure.
At the same time, it should be noted that any introduction of traffic organization measures (e.g. a traffic zone) may be initiated by the property owners through a residents' initiative and the adoption of an appropriate resolution by a majority vote.
What action did the cooperative take?
„Bolesławianka”: – In the course of the actions taken, the vehicle owner contacted the administration—he is a resident of the property in question. He was informed that blocking the entrance to the building was unacceptable and that he could park elsewhere.
The result? The cooperative's management board: – As a result, the vehicle was removed.
Are there procedures allowing a vehicle to be removed from the cooperative's property?
The management board of SM „Bolesławianka”:
On private property not covered by a traffic zone or residential zone, there are no simple procedures allowing a vehicle to be removed through administrative action, as is the case on public roads.
Action is limited to identifying the owner and requesting that they remove the obstruction; in the event of a dispute, the matter must be pursued through civil proceedings.
In practice, removing abandoned vehicles is easier than removing vehicles belonging to residents. Intervention by authorized services, including removing the vehicle or issuing a fine, is possible only to a limited extent.
The cooperative is not authorized to tow the vehicle away independently.
We asked how the property manager assesses the situation of elderly and disabled people who cannot pass through there freely. Here is the response:
The cooperative recognizes the problem of improper parking on private property, which is broader in nature and affects many cities in Poland. The introduction of paid parking zones on public roads increases parking pressure in residential areas.

The property manager adds:
In Bolesławiec, the Paid Parking Zone operates under Resolution No. XIX/205/2020 of the Bolesławiec City Council dated 20 May 2020, as subsequently amended, and covers public roads only. The zone is administered and permits are issued by Bolesławiec City Hall. This phenomenon also affects parking practices in residential areas, where the existing parking infrastructure is subject to increased pressure.
And adds:
At the same time, it should be noted that the growing number of vehicles and the size of the property available to the co-owners result in limited availability of parking spaces, which in practice leads to parking difficulties and conflicts beyond the control of individual users.
At the same time, the cooperative emphasizes that the situation described in the article was not long-lasting on the scale presented in the publication, and that it was resolved immediately after information about the problem was received.
