The District Prosecutor’s Office in Legnica has filed an indictment against 37-year-old Sławomir B., who on 17 September 2025 in Golanka Dolna, deliberately and grossly violating road safety rules, hit a motorcyclist who had no possibility of avoiding the accident. The rider suffered serious bodily injuries resulting in incapacity for independent living. The perpetrator fled the scene.
– The accident occurred at approximately 6:55 a.m. The victim was riding his motorcycle through Golanka Dolna from Legnica towards Prochowice. From the opposite direction, the accused, Sławomir B., was travelling through the village, driving a Volkswagen Touran – reports Liliana Łukasiewicz, press spokesperson for the District Prosecutor’s Office in Legnica.
B. was on his way to a job he performed occasionally. The spokesperson said: – He had never held a driving licence, and in the recent past he was again subject to a ban on driving motor vehicles. The vehicle had a registration plate that was not assigned to the car being driven. The vehicle did not have third-party liability insurance.
At the place where the incident occurred, Sławomir B., without using a turn signal, suddenly began turning right into one of the properties. As a result, he entered the lane in which the victim was travelling, approximately 20 metres away. The prosecutor:
The above-mentioned driver failed to give way. The motorcyclist tried to brake and perform an evasive manoeuvre by laying the motorcycle down on the asphalt, but despite this, the force of his momentum caused him to hit the front of the car blocking his path.
After stopping, the accused got out of the vehicle, but after realising the consequences of the incident, he got back in and hurriedly drove off towards Prochowice, without providing assistance or remaining at the scene until the emergency services arrived.
Witnesses to the incident tried to stop the perpetrator, but he drove around them and reversed so violently towards one of the people that he nearly hit them. Investigators:
A witness noted that the perpetrator behaved strangely, gesticulated, blamed the motorcyclist and appeared to be under the influence of psychoactive substances or in shock.
The spokesperson said: – As a result of the incident, the victim suffered extensive spinal injuries resulting in incapacity for independent living. These injuries constitute a serious illness that poses a real threat to life, as well as a serious, incurable and long-term illness. The above-mentioned person is completely unable to work. According to the opinion of a forensic medicine expert, the injuries constituted serious bodily harm.
She added: – Moreover, at the time of the accident, the accused failed to comply with the criminal measure imposed by a final judgment in a misdemeanour case dated 7 July 2025: a ban on driving all motor vehicles in land traffic for six months, from 31 July 2025 to 31 January 2026.
What does he face?
For causing the accident, the accused faces between nine months and 12 years in prison.
In addition, the court will have to order compensation for the victim of at least PLN 10,000 and a lifetime ban on driving all motor vehicles. Since the accused had previously been finally convicted of driving while intoxicated, the court will also have to order a payment of at least PLN 10,000 to the fund assisting victims.
The above-mentioned person was arrested on 1 October 2025 and temporarily detained at the prosecutor’s request. The court has now extended his detention until the end of March 2026.
Prosecutor Liliana Łukasiewicz explains:
Detention was imposed, among other reasons, because before the incident Sławomir B. had been hiding from law enforcement authorities, as he was suspected of twice driving a car under the influence of a narcotic substance, methamphetamine: on 5 October 2024 in Spalona, at a concentration of 259.2 ng/ml corresponding to a state of intoxication, and on 4 March 2025 in Legnica, at a blood concentration of 338.5 ng/ml corresponding to a state of severe intoxication. He committed these acts while having a final conviction for an offence under Article 178a §1 of the Penal Code; consequently, he has now been charged with offences under Article 178a §4 of the Penal Code, punishable by between three months and five years in prison.
Sławomir B. was also charged with twice driving a car on the day of the accident, 17 September 2025, using a registration plate not assigned to the above-mentioned vehicle, and with failing to comply with the criminal measure banning him from driving all motor vehicles, which was in force until 31 January 2026.
The accused formally admitted to the offences with which he was charged and gave explanations in which he nevertheless disputed that he could have avoided the accident. He said he drove away because he was in shock. He also admitted that he had registration plates not assigned to the vehicle. He further explained that on 17 September 2025 he drove despite the ban on driving all motor vehicles imposed on him because he wanted to get to work, and that he was aware of the judgment. He said he was afraid to report to the Police.
For all the alleged acts together, the accused faces between nine months and 12 years in prison, as well as the aforementioned criminal measures.
The case will be heard by the District Court in Legnica.
