The Legnica Regional Prosecutor’s Office has filed an indictment with the Legnica Regional Court against the perpetrators who unlawfully deprived the male victim of his liberty, inflicted bodily injuries on him and robbed him, as well as for other offenses, including drug-related offenses, offenses against life and health, and offenses against property. Five people in total are covered by the indictment.

The incidents took place on January 9, in the evening, in Polkowice. – When the male victim was leaving his friend’s apartment, he encountered two of the accused in the stairwell of the building. After an exchange of words, they attacked the victim, beating him with their hands and a machete, as well as kicking him – reports prosecutor Lidia Tkaczyszyn, press spokesperson for the Legnica Regional Prosecutor’s Office.

She adds: – The accused then threatened to kill the victim and took him by elevator to the apartment of one of the accused, located in the same building on an upper floor. During this time, two more perpetrators arrived at the premises.

And she adds: – Next, all four accused, after using violence against the victim by beating him with their hands and kicking him all over his body, took his mobile phone, a wallet containing a small amount of money, and his identity card, intending to appropriate them.

That was not the end. The prosecutor: – That same night, the accused led the victim to various places in Polkowice, beating and kicking him, setting his hair on fire, spitting at him and verbally abusing him with vulgar words.

At one point, when the attackers and their victim were near the Polkowice police station, the victim managed to break free from his persecutors and notify the police. The aggressors were arrested.

Prosecutor’s Office:

The accused inflicted the following bodily injuries on the victim: bruising, swelling, fractures of the nasal and jaw bones, a brain hematoma, a rib fracture and others, which resulted in impairment of the functions of body organs for a period exceeding 7 days.

The investigation established that the accused and their victim knew one another.

The indictment

The prosecutor charged all four perpetrators with unlawfully depriving the male victim of his liberty with particular cruelty, committing robbery against him using a dangerous tool in the form of a machete, participating in a beating, and causing bodily injuries lasting more than 7 days.

Prosecutor L. Tkaczyszyn: – Two of these accused are in temporary detention. In the case of the third accused, the Wrocław Court of Appeal, after considering an appeal, lifted the temporary detention and applied non-custodial preventive measures. The accused Paweł W., who was the first to act aggressively toward the victim and then inflicted injuries on him with a machete, is being tried in this case as a recidivist under Article 64 § 1 of the Criminal Code. He had previously been convicted of offenses against life and health and against property, for which he served a sentence of 1 year and 6 months’ imprisonment.

What sentence is threatened for this type of offense?

Five to 20 years in prison.

Other acts by the accused Paweł W. covered by the indictment

The prosecutor also charged Paweł W. with committing six further offenses, including: cultivating cannabis other than fiber hemp; supplying another person, for financial gain, with narcotic substances in the form of marijuana, that is, selling it; ordering the beating of another person; unlawfully depriving another victim of liberty; damaging property and violating domestic peace; and robbery during which he injured the victim and took a mobile phone, money and other property with the intention of appropriating them.

Investigators: – The deprivation of liberty in the above case consisted of bringing the male victim against his will to the accused’s apartment, where Paweł W. shot at the victim’s legs with an air rifle, attempting to force him to repay money owed for drugs sold. The accused committed most of these acts as a recidivist under Article 64 § 1 of the Criminal Code. The incidents took place between 2020 and 2023 in Polkowice.

The fifth accused

Spokesperson:

The prosecutor alleges that Paweł W. committed two of the offenses cited above jointly and in agreement with the fifth accused covered by this investigation. In addition to these acts, the prosecutor also accuses the fifth defendant of committing five further offenses: assault, burglary, theft, fraud and supplying marijuana for financial gain.

This accused is currently serving a prison sentence in another case.

The prosecutor alleges in the indictment that the accused committed a total of 13 offenses.
