We received several photos and a question from a reader, a resident of Warta Bolesławiecka Municipality: “Can anything be done so that residents do not have to look at such views?” The reader also sent several photos showing what some waste containers look like in Warta Bolesławiecka Municipality.
We forwarded the reader’s question to Warta Bolesławiecka Municipality. Here is the response we received from the Head of Warta Bolesławiecka Municipality, Mirosław Haniszewski:
In response to the email of 19 January 2021, the Head of Warta Bolesławiecka Municipality informs us that the question should be addressed to the owners of the properties next to which the containers visible in the submitted photos are located, or to their administrators. Pursuant to Article 5(1)(1) of the Act of 13 September 1996 on Maintaining Cleanliness and Order in Municipalities:
“1. Property owners shall ensure cleanliness and order by:
1) equipping the property with bags or containers intended for collecting municipal waste, maintaining those containers in an appropriate sanitary, orderly and technical condition, and maintaining waste collection areas in an appropriate sanitary and orderly condition...”, while pursuant to Article 2(3) of the aforementioned Act, “If a property is developed with a multi-unit building in which separate ownership of premises has been established, the obligations of the owner of the common property and the owner of the premises shall rest with the housing community or housing cooperative”
Furthermore, pursuant to § 6 of the Regulations on Maintaining Cleanliness and Order in Warta Bolesławiecka Municipality adopted by the Municipal Council (Resolution No. XVII/131/20 of 7 April 2020):
“1. Municipal waste must be collected in technically sound, lockable, leak-proof and clean containers and/or bags intended exclusively for this purpose.
(...)
3. The number of containers for collecting municipal waste should take into account the frequency and method of removing waste from the property and ensure that they do not overflow.
4. For collecting exceptionally large quantities of municipal waste and mixed waste generated as part of selective collection, in addition to standard containers, bags using colours corresponding to the colours of containers for collecting the relevant type of waste may be used
I would also like to remind you that:
- in the case of bulky waste and increased quantities of segregated waste, outside the scheduled collection period, it is possible to have it accepted free of charge at the PSZOK at the premises of the Municipal Services Company located at Lubków 63,

- after agreeing with the waste collection operator, namely Zakład Gospodarki Komunalnej w Lubkowie Sp. z o.o., it is possible to exchange unused waste collection containers for another type of container or order an appropriate number of additional containers, which will allow all waste generated between collections to be stored.
In summary, the municipal company provides both waste collection and the option of equipping properties with containers, while property owners are responsible for providing an appropriate number of containers, proper waste segregation and keeping waste collection areas clean.
