Officers from the Criminal Division of the Bolesławiec District Police Headquarters identified a man suspected of a theft that occurred on New Year's Eve. The 21-year-old took advantage of the fact that someone had failed to lock a basement and stole the skiing equipment kept inside. The victim estimated the value of the equipment at nearly PLN 2,000.
The 21-year-old was arrested. The man is well known to local police officers because he frequently committed traffic offences.
The officers recovered the stolen property. The suspect admitted his guilt. He now faces up to five years behind bars.
Update
We learned unofficially that this concerns motorcyclist Mateusz B., Bolesławiec's Frog, whom we have written about repeatedly, including in the articles: Is there no one who can stop Bolesławiec's Frog?, What about Bolesławiec's Frog? He has three cases in court, including one involving drugs. Let us recall: the young man had a serious accident in August 2014 on the road between Dobra (Bolesławiec commune) and Kliczków (Osiecznica commune). The one-wheeled vehicle's driver lost a leg (he now wears a prosthesis).
It might have seemed that after such an accident our Frog would come to his senses somewhat and tone things down. Nothing could be further from the truth. Videos repeatedly appeared on YouTube showing the man driving recklessly in a passenger car.
Last summer, it turned out that Bolesławiec's Frog had finally gone too far. The court issued a driving ban against Mateusz B. On Thursday, 7 July, the judgment became final. Since then, however, the road pirate had managed to violate the ban several times (the police disclosed six such cases).
The proceedings were conducted under the expedited procedure. The man was arrested and questioned on 10 July. The first hearing took place on Monday, 11 July, and the second four days later. It is known that 20 proceedings were pending against Mateusz B., 19 of them related to driving a car. During the hearing, the defence argued that B. did not know he was subject to a court-ordered driving ban and requested an acquittal.
On Friday, 15 July 2016, the judgment in B.'s case for violating the ban was finally handed down. The young man was sentenced to 10 months in prison, suspended for four years.
“I am not surprised that people were outraged by the defendant's behaviour. I saw the video myself showing the defendant fleeing from the police. I will not say what I thought then, because I would have to use unparliamentary language. This was not bravado, but ordinary stupidity bordering on insanity. To behave this way after an accident in which the defendant lost his leg?! There is nothing reasonable about it,” said Judge Paweł Wyrzykowski in his statement of reasons.
“I think there is a chance that the defendant will come to his senses. So far, his behaviour has not led to a tragedy involving bystanders. Fortunately, no one has been hurt so far. Now there is a prison sentence conditionally suspended. If the defendant drives a car in defiance of the ban, then now—let me put it plainly—things will get worse and worse. A certain threshold has been crossed. If this does not get through to you, you will go to prison,” the judge added.
Judgment: I find the defendant guilty of the act with which he was charged, described in the introductory part of the judgment, namely the offence under Article 244 of the Criminal Code, and pursuant to that provision I sentence him to 10 months' imprisonment. Pursuant to Article 69 paragraphs 1 and 2, Article 70 paragraph 2 and Article 73 paragraph 2 of the Criminal Code, I conditionally suspend the execution of the prison sentence imposed on the defendant for a probationary period of four years, placing him under the supervision of a probation officer. Pursuant to Article 72 paragraph 1 point 1 of the Criminal Code, I order the defendant, during the probationary period, to inform the probation officer of the course of the probation period. Pursuant to Article 63 paragraph 1 of the Criminal Code, toward the sentence imposed [sąd] I credit the defendant with the period of detention from 10 July to 11 July 2016 and charge the defendant with court costs, including a fee of PLN 180.
