Jelenia Góra resident Adam Dz. has been accused of storing, from January 2011 to July 2015 in Siedlęcin, in an area protected as part of the Bóbr Valley Landscape Park, and in breach of applicable regulations and without a permit, waste consisting of construction waste, fittings, furniture, plastic waste, car parts, fluorescent lamps, batteries, used oil, unsorted municipal waste and other materials. This could have caused a significant deterioration in water quality, reduced soil quality, caused substantial destruction of plant and animal life over a considerable area, and could pose a threat to human life and health.

Investigators established that in mid-2007, initially based in Jelenia Góra and later in Siedlęcin, the company D & D Recycling began operating. Its activities were intended to include, among other things, waste processing. The company’s shareholders were Krzysztof Dz. and Adam Dz., who also served as the company’s president. In 2012, Krzysztof Dz. transferred all his shares to Adam Dz.

On 2 June 2008, Adam Dz., acting on behalf of the company, leased the property at 4 Topolowa Street. On 16 July 2008, the company received a permit to transport waste.

At the beginning of 2011, residents began filing complaints about the creation of an “illegal waste dump” on the property. Among other reasons, this prompted the Jelenia Góra County Office to initiate proceedings to revoke the company’s waste-transport permit. During the proceedings, a site inspection confirmed that waste, including municipal waste, was being stored on Topolowa Street. The waste-transport permit was revoked by the Jelenia Góra county governor on 14 May 2012.
The storage of various materials at the site was also confirmed during an inspection conducted with the participation of police officers and a prosecutor.

Soil samples were collected from the property and subjected to further laboratory tests. An expert in waste management was also appointed, who stated that the materials stored on the property at 4 Topolowa Street in Siedlęcin should be considered waste within the meaning of the Waste Act. In the expert’s assessment, improper storage of the materials had contaminated the soil, potentially posing a threat to groundwater, plants and their consumers—animals and people.

Adam Dz. did not admit to committing the alleged offense. He faces up to five years in prison.
