This is an important judgment concerning transparency in public life in Bolesławiec. The Voivodeship Administrative Court in Wrocław found that Fundacja Wspierajmy Zdrowie in Bolesławiec had failed to act on a request for access to public information concerning the organization of the Gala Przyszłości Szpitala Św. Łukasza.

The judgment was issued on 7 May 2026. The case concerned questions sent by istotne.pl to the foundation on 4 November 2025, following the widely discussed gala held at the sports hall beside I Liceum Ogólnokształcące in Bolesławiec. From the outset, the event raised questions about costs, sponsors, donations, catering, alcohol and how the event was financed.

The court found that Fundacja Wspierajmy Zdrowie had failed to act with regard to part of istotne.pl’s request. The court ordered the foundation to consider the request within 14 days of being served with the final judgment.

In practice, this means that the foundation headed by Jolanta Sawczak will have to return to questions that were not previously answered in full.

The questions included:

What was the total cost of organizing the Gala przyszłości szpitala św. Łukasza, held on 25 October 2025 in Bolesławiec in the I LO hall?

What were the sources of funding for the event? Were they sponsors, donors, or was everything financed through participants’ donations? Please provide the total amounts or the scope of in-kind support.

Did the foundation enter into agreements with sponsors concerning support for the event? If so, please indicate the nature of that support—financial, in-kind or services.

Did renting the hall and technical facilities—sound system, lighting, stage, etc.—at I LO involve any costs? If so, who bore them and in what amount?

Was the catering for the event purchased or provided to the foundation as a donation? What was its value?

How many people made a donation, and how many were invited free of charge?

Were funds from donations and sponsors used exclusively to organize the Gala, or also for other statutory activities of the foundation? If the funds were used more broadly, please indicate the statutory purposes for which they were used.

The case has a broader context. Jolanta Sawczak is not only the president of Fundacja Wspierajmy Zdrowie. As we have reported, she also appears in the structures of Medask, a private entity cooperating with Szpital św. Łukasza. The hospital refused to disclose to us the amounts paid to that company, citing business confidentiality.

Damian Sawczak, a Bolesławiec City Councilor, is also on the board of Fundacja Wspierajmy Zdrowie. According to registry data, Jolanta Sawczak serves as the foundation’s president, while Damian Sawczak serves as its secretary. The foundation is therefore an entity where issues concerning the hospital, local politics and public interest in the spending of money and donations intersect.

The latest context surrounding the case is even broader. Following publications by istotne.pl, the Board of Bolesławiec County announced an inspection at Szpital św. Łukasza concerning the spending of funds granted to the hospital in county subsidies. The county also instructed the facility’s director to provide explanations.

This means that the court’s judgment in the case involving Fundacja Wspierajmy Zdrowie comes at a time when more and more questions are arising around the hospital and entities connected with its surroundings. This time, the issue is no longer limited to political assessments or commentary, but concerns a decision by an administrative court: the foundation failed to act and must consider the request for public information.

The court also ordered Fundacja Wspierajmy Zdrowie to pay Krzysztof Gwizdała of istotne.pl PLN 100 as reimbursement of court proceedings costs. The judgment is to be justified ex officio and served on the parties to the proceedings. The written reasoning will also show in detail how the court assessed the foundation’s obligations and the scope of information that should be disclosed.
