A serious road accident occurred in February 2026 near Kawice. According to the prosecutor’s office, the 24-year-old resident of Legnica County was driving with at least 2.8 per mille of alcohol in his system, despite an existing driving ban. His 18-year-old sister suffered serious injuries when the car rolled over.
The indictment in the case was filed with the court by the District Prosecutor’s Office in Legnica. Investigators accuse the 24-year-old of causing an accident while under the influence of alcohol and violating a court-ordered driving ban.
He lost control of the car and rolled over
The incident occurred on February 2, 2026, on a public road near Kawice. Investigators determined that the driver failed to exercise caution and was driving at a speed that prevented him from controlling the car.
The car veered onto the right shoulder, struck the embankment of a roadside ditch, and then rolled over in a field.
The driver’s 18-year-old sister was in the vehicle. The young woman sustained multiple injuries, primarily to her face. According to the prosecutor’s office, the injuries caused serious damage to her health in the form of permanent and significant disfigurement.
He drove despite a ban and revoked licence
Investigators emphasize that the man had previously been convicted of driving under the influence of alcohol. In 2022, he was convicted of driving a car after drinking alcohol—while a driving ban was in force.
Additionally, by a decision of the Starosta of Legnica dated August 2023, his driving entitlements were revoked.
Despite this, he got behind the wheel again.
“I got into the car out of stupidity”
During questioning, the suspect admitted that he had drunk alcohol the previous day but believed he could drive. He also claimed that he remembered little about the moment of the accident itself.
He explained that he was driving to sell cans. He also admitted that he knew about the driving ban.
He reportedly told investigators that he got into the car “out of stupidity” and regretted it.
According to information provided by the prosecutor’s office, his sister forgave him for causing the accident. However, the injured woman does not remember the incident itself.
Experts: alcohol addiction is the problem
Psychiatric experts assessed that the defendant’s behavior was connected with his alcohol addiction. In their opinion, there is a high risk that he could commit a similar offense in the future.
Consequently, the experts considered it justified to impose a protective measure on him—addiction treatment.
He faces up to 10 years in prison
The man will stand trial before the District Court in Legnica. The acts he is accused of carry a prison sentence of between 3 and 10 years.
The case is one of the first concerning the new provisions of the Criminal Code, which have been in force since January 29, 2026, and provide for harsher consequences for perpetrators of serious road accidents committed under the influence of alcohol.
