After being brought before the Jelenia Góra District Prosecutor’s Office, the suspects were charged with exceeding their official powers between 25 March 2023 and 3 April 2023 by disclosing to unauthorised persons information they had obtained as police officers from the National Police Information System in connection with their official duties and as part of operational activities conducted in a search case, thereby acting to the detriment of the public interest.
In addition, one of the police officers was charged with promising to provide two police officers with a material benefit, in the form of alcohol, in exchange for conduct constituting a breach of the law.
For the offences they are accused of, the police officers face between one and ten years in prison.
The following person was also charged with committing an offence: a 47-year-old resident of Karkonosze County who induced a police officer to provide him with classified information from the National Police Information System and operational findings, including information concerning the whereabouts of a wanted person. The suspect then passed this information to the interested person, thereby enabling them to continue hiding from law enforcement authorities.
The offence he is accused of, classified under Article 18 § 2 of the Penal Code in conjunction with Article 231 § 2, Article 266 § 2 and Article 239 § 1 of the Penal Code, is punishable by between one and ten years in prison.
When questioned as suspects, they did not admit to committing the acts they were accused of. They gave explanations.
At the prosecutor’s request, the local District Court ordered pre-trial detention for two months for one of the police officers and for three months for the 47-year-old person who had induced him to unlawfully pass on information constituting an official secret.
The remaining suspects were subjected to non-custodial preventive measures in the form of a property bond of PLN 15,000, police supervision until and suspension from the official duties of a police officer.
The detentions resulted from a joint investigation by the Jelenia Góra District Prosecutor’s Office and the Internal Affairs Bureau of the National Police Headquarters in Warsaw.
The suspects are officers subordinate to the Municipal Police Headquarters in Jelenia Góra: two have served for 24 years, one for 21 years and one for 13 years.
