We wrote about the matter in the article Will they remove the asphalt from the roads to Relich’s home? At the Nowogrodziec Municipal Council session on 13 May, councillors were informed that two roads in Gierałtów leading to the property of the former mayor of Nowogrodziec constituted illegal construction. The councillors were to decide by 14 May whether to dismantle the roads or begin the less costly procedure of legalising the illegal construction.

“The municipality will pursue financial claims against the people responsible for creating this situation, in order to cover both the legalisation costs and the losses caused to the local government by the illegal construction,” mayor Joanna Świder informs us.

Dear Editor,
in response to your inquiry concerning illegal construction on road plots no. 455 and 456 in Gierałtów, I inform you that the matter was presented to the Municipal Council in Nowogrodziec during its 16th session. Some councillors spoke and expressed their opinions on the matter, but the Council did not adopt any formal resolution—the issue was not put to a vote.

Given the seriousness of the situation and the need to limit the costs of further proceedings, I believe that legalising the road in question would be the most reasonable solution. This means paying legalisation fees and the costs of preparing construction designs. At the same time, however, the municipality will pursue financial claims against the people responsible for creating this situation, in order to cover both the legalisation costs and the losses caused to the local government by the illegal construction.

The matter of the illegal construction will be referred to the prosecutor’s office. At the same time, it should be emphasised that the Nowogrodziec Municipality also incurred specific costs for constructing this road—both for materials and labour—which amount to approximately PLN 180,000. These funds should also be reimbursed by the people responsible.

Assessing any potential breach of official duties by specific individuals remains the responsibility of the relevant services and the court.
As for the Municipal Council’s further decisions in this matter, any action taken by that body should be established directly with the Chairwoman of the Municipal Council.
