According to expert witnesses’ accounts, he lost control of his emotions because... the child was crying.
The verdict? 25 years in prison. The District Prosecutor’s Office in Legnica has already announced an appeal because, according to investigators, the only just punishment in this case would be life imprisonment. (Details on the Radio Wrocław website).
Let us recall. The dramatic incident occurred on the evening of St. Nicholas Day, December 6, 2020, in one of the apartments on Batorego Street in Legnica. At approximately 4:00 p.m., an emergency medical team was called. Unfortunately, the death of the 9-month-old child was pronounced.
“Because the paramedics found injuries to the boy’s head, the police were called to the scene,” she told the onet.pl website, prosecutor Lidia Tkaczyszyn, spokesperson for the District Prosecutor’s Office in Legnica, said at the time. “The forensic medicine expert who arrived at the scene confirmed the injuries to the boy’s head, explicitly identifying craniocerebral trauma.”
Investigators opened proceedings concerning infanticide. The suspect was the victim’s 46-year-old father at the time, who had a criminal past (he had spent 12 years in prison for... an assault resulting in death). At the time of his arrest, the man had a blood alcohol level of 1.5 per mille.
The boy’s mother was not at home when the tragedy occurred.
