Judges: The fine for not wearing a mask is now lawful. We may pay as much as PLN 500...

As we read on the Facebook profile of Stowarzyszenia Sędziów Polskich IUSTITIA:

The general requirement to cover the nose and mouth was initially introduced by exceeding the limits of the statutory authorization. To rectify this error, on 28 October 2020 the Sejm passed an act amending certain acts in connection with counteracting crisis situations related to the occurrence of COVID-19. Article 15(2)(c) of that act introduced an amendment to Article 46b of the Act of 5 December 2008 on preventing and combating infections and infectious diseases in humans, consisting in adding point 13 to Article 46b.”

The proper, lawful legal basis for the obligation to wear masks is now the Regulation of the Council of Ministers of 19 March 2021 (issued on the basis of statutory authorization).

Masks do not have to be worn:
- at home,
- in a forest, park or on the beach,
- in one’s own car or during examinations.

For not wearing a mask, the police may issue a PLN 500 fine.
