A reader, commenting on the topic of the littered area near the Krępnica water reservoir, drew attention to a situation he encountered in December 2020:

(...) Because of the work we do in construction, we collect mixed waste from every construction site in bags and, from time to time, load everything onto a truck and take it for a fee to the landfill in Trzebień (where it belongs). I was surprised when I arrived there and, in a manner far from professional—indeed, rather brusquely—was told by a “gentleman” through the window that he would not accept the waste.

I returned with it to the MZGK office in Bolesławiec, but unfortunately, a longer conversation with a woman from the department dealing with waste also produced no result (even though I wanted to pay), so I returned to the workshop with the waste. I condemn those who dump waste in the forest, but after my unpleasant experience I am beginning to understand them. Regards to the “gentleman” with the goatee at the Trzebień landfill and to the MZGK management on Staszica Street in Bolesławiec. P.S. The situation I have briefly described is quite recent—it took place in December 2020.

Here is the response we received from Miejski Zakład Gospodarki Komunalnej Sp. z o.o. in Bolesławiec:

Dear Sir or Madam,

With reference to the comment posted on your website on 4 January 2021, we inform you that the Municipal Waste Neutralisation Plant in Trzebień, acting in accordance with Decision No. PZ/23/2018 of 5 December 2018, issued by the Marshal of the Lower Silesian Voivodeship, is obliged to verify and inspect waste suppliers with regard to the waste delivered and to verify the permits required by law for particular types of waste.

Pursuant to Article 50(1) of the Waste Act, a number of types of activity are subject to entry in the BDO Register upon application. In such cases, entrepreneurs must submit an application for entry in the Register themselves. The application must be submitted using the electronic registration form via the website: www.bdo.mos.gov.pl. According to the explanation issued by the Ministry of Climate, an entity that generates waste resulting from the construction, demolition or renovation of structures, the cleaning of tanks or equipment, and cleaning, maintenance or repairs is responsible for disposing of that waste and is required to register with BDO and keep records in BDO.

Furthermore, the Regulation of the Minister of Economy of 16 July 2015 on the admission of waste for disposal in landfills—in this case, mixed waste from construction, renovation and dismantling with code 17 09 04—specifies:

  1. Inert waste for which the basic waste characteristics are prepared without conducting the tests referred to in Article 110(2)(1)(h) of the Act of 14 December 2012 on Waste, hereinafter referred to as the “Act”;
  2. Criteria for admitting waste to a landfill for a given type of waste;
  3. The scope of the tests referred to in Article 117(1) of the Act.

In this case, Mr [nazwisko do wiadomości redakcji] running a construction business has a legal obligation to register in the BDO system. In addition, as stipulated by the Regulation of the Minister of Economy of 16 July 2015, mixed waste from construction, renovation and dismantling with code 17 09 04 also requires the presentation of a basic waste characteristics sheet and possession of laboratory documentation for the waste in question. The situation described clearly indicates that the waste supplier did not fulfil his legal obligations, and therefore the Municipal Waste Neutralisation Plant in Trzebień could not accept the waste in question.

At the same time, we inform you that every entity planning to deliver waste to the Installation in Trzebień is informed of the conditions it must meet in order to deliver waste lawfully and sign an appropriate waste acceptance agreement.

An entrepreneur planning to deliver waste to the Municipal Waste Neutralisation Plant in Trzebień is asked to contact us by telephone at 75 735 42 71. Our employees will explain the procedures for accepting waste at the installation and help resolve the problem of waste management.

If Mr [nazwisko do wiadomości redakcji] fulfils this obligation and signs an agreement, he will be able to deliver waste to the installation in Trzebień.
