The individual chapters set out detailed rules for maintaining cleanliness and order in the city of Bolesławiec, in particular:

  1. requirements concerning the maintenance of cleanliness and order on properties;
  2. types and minimum capacity of containers, including bags, intended for collecting municipal waste on properties and public roads, as well as the conditions for locating these containers and keeping them in an appropriate sanitary, orderly and technical condition;
  3. the frequency and method of removing municipal waste and liquid waste from properties and areas intended for public use;
  4. other requirements arising from the provincial waste management plan;
  5. the obligations of people who keep pets, intended to protect people from danger or nuisance and to prevent pollution of areas intended for common use;
  6. requirements concerning the keeping of farm animals in areas excluded from agricultural production;
  7. the designation of areas subject to mandatory deratization and the dates on which it is to be carried out.

Requirements concerning the maintenance of cleanliness and order on properties

2.1. Property owners are required to collect municipal waste selectively, including the following fractions:

  1. paper;
  2. glass;
  3. metal and plastics, as well as multi-material packaging waste;
  4. biowaste;
  5. waste that is not classified as medical waste, generated in a household as a result of administering medicinal products by injection and monitoring blood substance levels, in particular needles and syringes;
  6. expired medicines and chemicals;
  7. spent batteries and accumulators;
  8. waste electrical and electronic equipment;
  9. furniture and other bulky waste;
  10. construction and demolition waste, meaning waste generated during minor renovation work carried out independently by property owners, which constitutes municipal waste;
  11. textiles and clothing;
  12. waste tyres;
  13. hazardous waste constituting municipal waste.

2. The waste listed in paragraph 1, points 1–4 and points 8 and 9, is collected directly from properties covered by the municipality-organized municipal waste collection system.

3. The waste fractions listed in paragraph 1, points 1–13, are accepted at the Selective Municipal Waste Collection Point only from owners of properties covered by the municipality-organized municipal waste collection system.

4. Property owners are required to:

  1. not store waste in places not intended for this purpose;
  2. not dispose of municipal waste from households or from properties where no residents live but waste is generated, such as shops, catering and service establishments and other properties, in street bins or containers belonging to other owners;
  3. not dispose of municipal waste from properties where no residents live but municipal waste is generated, such as shops, catering and service establishments and other properties, in publicly accessible containers located at neighborhood selective municipal waste collection points in the city;
  4. not burn municipal waste on the ground or in building heating installations;
  5. not place waste remaining after sorting in containers intended for selective collection;
  6. not place waste of a type other than that intended for a given container or bag in it;
  7. not leave waste beside containers intended for its selective collection, even if they are temporarily overfilled;
  8. not place in containers for selectively collected waste or waste remaining after sorting such items as construction rubble, sludge, toxic, corrosive or explosive substances, packaging contaminated by hazardous substances such as motor oils, herbicides and insecticides, hot ash, dead animals, medical and veterinary waste, snow or ice;
  9. not leave containers or bags intended for collecting municipal waste outside the property in a manner that creates a danger to third parties.

3.1. Property owners carry out selective municipal waste collection in the following ways:

  1. individual—meaning selective collection of municipal waste on the property in containers or special bags adapted for this purpose;
  2. collective—meaning selective collection of municipal waste in containers provided by the city and located within its area: blue for paper, green for glass, and yellow for metal, plastics and multi-material packaging waste.

2. Depending on the type of development, property owners are required to collect and hand over the municipal waste listed below as follows:

  1. in single-family housing:
    a) paper—in a separate container or bag,
    b) metal and plastics, as well as multi-material packaging waste—in a separate container or bag,
    c) biowaste—in a separate container or bag,
    d) glass—in a separate container or bag,
    e) waste remaining after sorting—in a separate container;
  2. in multi-family housing and on properties where residents live in part of the property and do not live in another part:
    a) paper—in a separate container,
    b) metal and plastics, as well as multi-material packaging waste—in a separate container,
    c) biowaste—in a separate container,
    d) glass—in a separate container,
    e) waste remaining after sorting—in a separate container;
  3. on properties where no residents live but municipal waste is generated:
    a) paper—in a separate container,
    b) metal and plastics, as well as multi-material packaging waste—in a separate container,
    c) biowaste—in a separate container,
    d) glass—in a separate container,
    e) waste remaining after sorting—in a separate container.

4.1. Requirements concerning the composting of biowaste constituting municipal waste in household composters:

  1. on properties inhabited by residents and developed with single-family buildings, only biowaste generated on that property may be composted;
  2. composting biowaste on a property must not cause nuisance to users of neighboring properties;
  3. biowaste must be composted in ready-made garden composters or wooden composters with an openwork structure, with a capacity of at least 3 m³, made of boards or impregnated beams arranged to ensure air access to the compost layers;
  4. the composter should be located in a place sheltered from wind and shaded, which ensures lower moisture loss from the compost;
  5. the composter should be covered to protect it from rain and snow;

2. Composting biowaste constituting municipal waste may not be carried out in pits or concrete tanks that restrict air access.

3. Composting biowaste does not exempt a property owner from the obligation to have a container or bag for biowaste.

5. Property owners are required to ensure that the sidewalk running along their property and directly adjacent to its boundary is cleared of snow, ice, mud and other pollutants, placing them where they do not obstruct pedestrian or vehicle traffic. This obligation does not apply to sidewalks where paid stopping or parking of motor vehicles is permitted.

6. On a property, washing motor vehicles outside car washes may be carried out only if:

    1. washing motor vehicles does not pollute the environment;
    2. biodegradable products are used;
    3. washing takes place on designated, paved parts of the property;
    4. wastewater from washing motor vehicles is discharged into the sanitary sewer or combined sewer system in accordance with applicable regulations, or collected in sealed cesspools;
    5. the wastewater referred to in point 3 is not discharged into bodies of water, onto the ground or into the stormwater drainage system.

7.1. On a property, repairing motor vehicles outside repair shops is prohibited, subject to paragraph 2.

2. Motor vehicle repairs are permitted outside repair shops:

  1. in the event of a breakdown, when minor repairs or immediate actions are performed to enable continued travel or starting the vehicle;
  2. in garages or on designated, paved parts of the property, provided that:
    a) repairing motor vehicles does not pollute the environment,
    b) waste generated during repairs is collected in containers intended for this purpose and transferred for disposal in accordance with separate regulations,
  3. when it does not cause nuisance to the owners or co-owners of the property where the repairs are carried out or to the owners or co-owners of neighboring properties.

Types and minimum capacity of containers, including bags, intended for collecting municipal waste on properties and public roads, conditions for locating these containers and keeping them in an appropriate sanitary, orderly and technical condition

8.1. Property owners shall maintain cleanliness and order on their properties by equipping them with closed, sealed containers of a specified type and minimum capacity, intended exclusively for this purpose and adapted for emptying by specialized vehicles.

2. The capacity of containers intended for collecting municipal waste must be adapted to the amount of waste generated on the property and the frequency of emptying.

3. The following types of containers intended for collecting municipal waste on properties are established, subject to paragraph 4:

  1. containers with a capacity of 120 l;
  2. containers with a capacity of 240 l;
  3. containers with a capacity of 360 l;
  4. containers with a capacity of 660 l;
  5. containers with a capacity of 1,100 l;
  6. containers for selective collection of paper; glass; metal and plastics and multi-material packaging waste; and biowaste, in single-family and multi-family housing, with a capacity of at least 120 l;
  7. publicly accessible containers for selective collection of paper, glass, metal and plastics, as well as multi-material packaging waste, with a capacity of at least 1,100 l;
  8. street bins on public roads with a capacity of at least 35 l.

4. The use of the following is permitted:

  1. containers with a capacity of 60 l for non-residential properties where municipal waste is generated, if no more than two people use the container;
  2. containers with a capacity of 80 l in single-family housing for households of no more than two people;
  3. bags for selective collection of paper, glass, metal and plastics, multi-material packaging waste and biowaste, with a capacity of at least 120 l.

5. For selective waste collection, the following color markings apply to containers and bags intended for collecting:

  1. paper—blue;
  2. glass—green;
  3. metal and plastics, as well as multi-material packaging waste—yellow;
  4. biowaste—brown;
  5. waste remaining after sorting—black, gray or graphite.

9.1. The total minimum capacity of containers intended for collecting waste on a property, while maintaining the emptying frequency specified in § 12, should be:

  1. for a residential property—at least 55 l per resident of the property;
  2. for a property where work is performed—at least 15 l per person working under an employment contract, contract of mandate, contract for specific work or another legal title, and additionally in the case of:
    a) schools of all types, preschools and nurseries—at least 5 l per pupil, student or child;
    b) catering premises or gardens—at least 20 l per user;
    c) hospitals, boarding schools, hotels, guesthouses and other similar facilities—at least 15 l per bed;
    d) allotment gardens—at least 5 l per designated plot;
    e) cinemas, theaters and auditoriums—at least 5 l per audience seat;
    f) cemeteries—at least 2 l per burial place;
    g) market squares—1.5 l per square meter of market-square area;
    h) other properties not listed above—according to need, but not less than 120 l per property.
  3. summer houses and other properties used for recreational purposes
    not less than 120 l per summer house or other property used for recreational purposes.

2. Owners of properties where residents live in part of the property and do not live in another part, while municipal waste is generated, calculate the required number of containers with which they must equip the property as the sum of container capacities calculated on the basis of paragraph 1, point 1, and depending on the type of activity conducted, listed in paragraph 1, point 2.

10.1. Containers for collecting municipal waste must be placed in a separate, easily accessible location on the property from which the waste is collected.

2. On the day of municipal waste collection, containers and bags should be placed at the property boundary or directly beside the fence in front of the property, in a manner that causes no nuisance or inconvenience to residents and does not obstruct pedestrian or vehicle traffic.

3. Containers for collecting municipal waste must be kept in an appropriate sanitary, orderly and technical condition by:

  1. washing and disinfecting them at least once a year;
  2. preventing them from becoming overfilled;
  3. keeping their lids closed;
  4. conducting inspections and maintenance to ensure that waste does not escape, including under the influence of wind, rain and other external factors, and replacing containers when damage or destruction makes further use impossible.

It is prohibited to put snow, ice, hot ash, toxic or explosive substances, or other items that are not the type of waste collected in them, into containers or bags for municipal waste.

To keep bags in proper technical condition, they must not be allowed to become overfilled or damaged.

If a waste bag is damaged, for example torn, the waste must be collected immediately or transferred to a sealed bag, and the area must be cleared of scattered waste.

To keep waste collection areas in an appropriate sanitary and orderly condition, municipal waste must not be stored outside bags and containers or in random locations.

Frequency and method of removing municipal waste and liquid waste from properties and areas intended for public use

11.1. Property owners are required to remove municipal waste from their properties in a manner ensuring cleanliness and order on the property.

2. The following method of removing municipal waste from properties is established:

  1. waste remaining after sorting must be placed in black, gray or graphite containers;
  2. paper must be placed in blue containers or bags for selective collection, or delivered to a selective municipal waste collection point;
  3. glass must be placed in green containers or bags for selective collection, or delivered to a selective municipal waste collection point;
  4. metal and plastics, as well as multi-material packaging waste, must be placed in yellow containers or bags for selective collection, or delivered to a selective municipal waste collection point;
  5. biowaste must be placed in brown containers or bags for selective collection, or delivered to a selective municipal waste collection point;
  6. expired medicines must be delivered to a selective municipal waste collection point or placed in marked containers at designated pharmacies, a list of which is available on the websites of the Bolesławiec City Hall and at the headquarters of the Bolesławiec City Hall.
  7. waste that is not classified as medical waste, generated in a household as a result of administering medicinal products by injection and monitoring blood substance levels, in particular needles and syringes, must be delivered to a selective municipal waste collection point;
  8. chemicals must be delivered to a selective municipal waste collection point;
  9. spent batteries must be delivered to a selective municipal waste collection point or placed in containers intended for this purpose located in designated public-use facilities, a list of which is available on the websites of the Bolesławiec City Hall and at the headquarters of the Bolesławiec City Hall.
  10. spent accumulators must be delivered to retail establishments obliged to collect this waste or to a selective municipal waste collection point;
  11. waste electrical and electronic equipment will be collected upon request, or must be delivered to a selective municipal waste collection point;
  12. furniture and other bulky waste will be collected upon request, or must be delivered to a selective municipal waste collection point;
  13. construction and demolition waste, meaning waste generated during minor renovation work carried out independently by property owners, which constitutes municipal waste, must be delivered to a selective municipal waste collection point or transferred to an enterprise conducting municipal waste collection activities, by placing it in containers intended for collecting this type of waste;
  14. textiles and clothing must be delivered to a selective municipal waste collection point;
  15. waste tyres must be delivered to a selective municipal waste collection point;
  16. hazardous waste constituting municipal waste must be delivered to a selective municipal waste collection point.

12.1. To prevent containers from becoming overfilled, the following frequency for removing municipal waste is established:

  1. waste remaining after sorting is collected:
    a) in single-family housing—at least once a week;
    b) in multi-family housing—at least once a week;
    c) from other properties—at least once a week.
  2. selectively collected paper and glass waste is collected:
    a) in single-family housing—at least once a month;
    b) in multi-family housing—at least twice a month, and in June–August at least four times a month;
    c) from other properties—at least twice a month;
  3. selectively collected metal and plastics, as well as multi-material packaging waste, is collected:
    a) in single-family housing—at least twice a month;
    b) in multi-family housing—at least twice a month, and in June–August at least four times a month;
    c) from other properties—at least twice a month;
  4. selectively collected biowaste is collected:
    a) in single-family housing—at least twice a week from April to November and at least once a week from January to March and in December;
    b) in multi-family housing—at least three times a week from April to November and at least once a week from January to March and in December;
    c) from other properties—at least once a week.
    d) Construction and demolition waste should be removed systematically during the work, but no later than within two days after completion of construction, renovation or modernization work.
    e) Furniture and other bulky waste will be collected upon request.
    f) Owners of properties where no residents live but municipal waste is generated, who are not covered by the municipality-organized municipal waste management system, shall transfer the collected waste to the enterprise with which they have concluded a municipal waste collection agreement.
    g) The owner of a property is required to remove municipal waste generated during organized mass events systematically, but no later than:
    1. from April to September:
      a) for events ending by 8:00 p.m.—within two hours of the end of the event;
      b) for events ending after 8:00 p.m.—within 10 hours of the end of the event;
    2. from October to March:
      a) for events ending by 5:00 p.m.—within two hours of the end of the event;
      b) for events ending after 5:00 p.m.—within 14 hours of the end of the event.
      c) Bins for collecting waste in public-use areas and on public roads should be emptied often enough to prevent them from becoming overfilled, but no less frequently than once a week.

13.1. Liquid waste must be removed from properties equipped with cesspools at a frequency dependent on the amount of liquid waste generated on the property and the tank’s capacity, ensuring continuous use of the tank and preventing liquid waste from escaping, subject to paragraph 2.

2. Liquid waste collected in cesspools must be removed at least once every six months.

3. The owner of a property where events are organized is required to provide a sufficient number of sealed portable toilet tanks, appropriate to the number of event participants.

Other requirements arising from the provincial waste management plan

14.Property owners are advised to take measures to reduce the amount of waste generated, in particular by:

  1. buying products in returnable packaging,
  2. limiting purchases of disposable products,
  3. avoiding the use of sandwich paper and aluminum foil and using plastic food containers instead,
  4. reusing certain items and extending their useful life,
  5. avoiding the use of plastic shopping bags and using cloth bags instead,
  6. composting biodegradable waste in households,
  7. buying beverages in glass bottles and with a deposit,
  8. reusing jars,
  9. donating unwanted clothing to social welfare centers,
  10. avoiding products that become hazardous waste when discarded,
  11. using rechargeable accumulators instead of disposable batteries,
  12. using reusable containers and boxes.

Obligations of people who keep pets, intended to protect people from danger or nuisance and to prevent pollution of areas intended for common use

15.1. People who own or care for pets are required to provide proper care for them.

2. A person keeping pets is required to provide constant and effective supervision of them.

3. A person keeping pets is required to prevent them from escaping uncontrolled from the place where they are kept.

16. A person whose pet is under their direct supervision or care in areas intended for common use is required to immediately remove contamination left by the animal.

17. In areas intended for common use, dogs are recommended to be walked in a manner ensuring control over them, for example on a leash or in a muzzle.

18. A person keeping an aggressive animal is required to equip the property with a visible warning sign clearly stating that such an animal is kept on the property, and, when taking it outside, to use a leash and muzzle.

Requirements concerning the keeping of farm animals in areas excluded from agricultural production

19. In areas excluded from agricultural production, farm animals raised exclusively for the needs of one’s own household may be kept under the following conditions:

  1. farm animals must be kept on the property in a manner preventing them from leaving it;
  2. keeping farm animals must not cause nuisance to users of neighboring properties, be a source of unpleasant odors or noise, or cause pollution of the property, surface water or groundwater;
  3. waste and refuse generated in connection with keeping farm animals must be collected and removed in accordance with applicable regulations.

Designation of areas subject to mandatory deratization and the dates on which it is to be carried out

20.1. Areas subject to mandatory deratization are:

  1. facilities where waste collection or processing activities are carried out;
  2. wastewater treatment facilities;
  3. multi-unit buildings, including public-use buildings;
  4. facilities associated with the production, trade and storage of agricultural products and foodstuffs;
  5. facilities associated with agri-food processing;
  6. animal breeding and rearing facilities;
  7. places where animals are temporarily held;
  8. facilities where collective catering is provided.

2. Deratization must be carried out at least twice a year, in April/May and October/November.

Final provisions

21. Employees of the Bolesławiec City Hall authorized by the Mayor of Bolesławiec and employees of entities authorized to conduct inspections under separate regulations are entitled to carry out inspections concerning compliance with the provisions of these Regulations.
