For several days, we have had heavy snowfall. Concerned for residents’ safety, police remind owners and managers of properties and buildings that they are required to clear snow from roofs and sidewalks. Anyone who fails to fulfill this obligation must expect consequences, including the immediate prohibition of using the building.

Officers:

Pursuant to Article 91a of the Construction Law, anyone who fails to fulfill the obligation specified in Article 61 to maintain a building in proper technical condition, uses a building contrary to regulations, or fails to ensure the safety of using a building is subject to a fine of not less than 100 daily rates, a restriction of liberty, or imprisonment for up to one year.

Pursuant to Article 117 of the Code of Petty Offences, anyone who fails to maintain cleanliness and order within a property, fails to perform their duties, or does not comply with instructions and orders issued by the competent authorities is subject to a fine of up to PLN 1,500 or a reprimand.

They add:

A person bearing these obligations may also incur civil liability for accidents occurring on the property.

And they stress:

Particular attention should be paid to large-area facilities, including hypermarkets, market halls and sports halls, as well as warehouses. Snow overhangs falling from roofs can seriously injure or even kill a person, so we appeal to everyone to use their imagination.
