We have written repeatedly about motorcyclist Mateusz B., the Bolesławiec Frog, in our articles, including: Is no one able to stop the Bolesławiec Frog?, What about the Bolesławiec Frog? He has three cases in court, including one involving drugs. Let us recall: the young man had a serious accident in August 2014 on the road between Dobra (Bolesławiec municipality) and Kliczków (Osiecznica municipality). The two-wheeler driver lost a leg (he now wears a prosthesis).
It might have seemed that after such an accident our Frog would come to his senses somewhat and tone things down. Nothing could be further from the truth. Videos regularly appeared on YouTube showing the man driving recklessly in a passenger car.
Recently it turned out that the Bolesławiec Frog had finally gone too far. The court banned Mateusz B. from driving vehicles. On Thursday, July 7, the judgment became legally binding. Since then, however, the road pirate has managed to violate the ban several times (the police identified six such cases).
The proceedings were conducted under an expedited procedure. The man was arrested and questioned on July 10. The first hearing took place on Monday, July 11, and the second four days later. It is known that 20 proceedings are pending against Mateusz B., 19 of them related to driving a car. During the hearing, the defense argued that B. did not know he was subject to a court-ordered driving ban and requested an acquittal.
On Friday, July 15, the judgment was finally delivered in the case against B. for violating the ban. The young man was sentenced to 10 months in prison, suspended for four years.
“I am not surprised that people were outraged by the defendant’s behavior. I myself saw a video of the defendant fleeing from the police. I will not say what I thought at the time, because I would have to use unparliamentary language. This was not bravado, but ordinary stupidity bordering on insanity. To behave this way after an accident in which the defendant lost a leg?! It has nothing to do with common sense,” Judge Paweł Wyrzykowski said in his justification.
“I think there is a chance that the defendant will come to his senses. So far, his behavior has not led to a tragedy involving bystanders. Fortunately, no one has been hurt so far. Now there is a custodial sentence with a conditional suspension. If the defendant drives a car in defiance of the ban, then now—I will put it plainly—things will get worse and worse. A threshold has been crossed. If this does not get through to you, you will go to prison,” the judge added.
The judgment: I find the defendant guilty of the act attributed to him, described in the introductory part of the judgment, namely the offense under Article 244 of the Criminal Code, and pursuant to that provision sentence him to 10 months’ imprisonment. Pursuant to Article 69 paragraphs 1 and 2, Article 70 paragraph 2 and Article 73 paragraph 2 of the Criminal Code, I conditionally suspend the execution of the custodial sentence imposed on the defendant for a probation period of four years, placing him under the supervision of a probation officer. Pursuant to Article 72 paragraph 1 point 1 of the Criminal Code, I order the defendant, during the probation period, to inform the probation officer about the course of the probation period. Pursuant to Article 63 paragraph 1 of the Criminal Code, toward the sentence imposed, [sąd] I credit the defendant with the period of detention from July 10 to July 11, 2016, and charge the defendant with court costs, including a fee of PLN 180.
