After obtaining an expert opinion in the field of construction in this case, the former construction supervision inspector, 58-year-old Jan W. from Legnica, was charged with improperly supervising the execution of the works, which caused significant financial damage to the property of Głogów Municipality amounting to nearly PLN 590,000.

In autumn 2014, one of the Głogów councillors reported the suspected crime in this case through the CBA. After conducting the evidentiary proceedings, the prosecutor appointed a construction expert to determine whether the road had been built correctly.

The opinion indicates that the investment was carried out in accordance with the construction design, but not in accordance with the submitted bill of quantities, the contract and the investor’s cost estimate, as one of the planned road layers—the binder course—was not constructed.

Responsibility for this state of affairs lies with the construction supervision inspector appointed for the investment. His duties included participating in the acceptance of individual construction stages, checking the quality of the completed works, verifying the materials used, and inspecting works that would subsequently be concealed or cease to be visible. The inspector was supposed to ensure the investor’s safety and certainty that no errors would be made and that the construction would be completed without defects.

In connection with the irregularities identified, Jan W., who was then serving as the construction supervision inspector, was charged in March 2016. The aforementioned suspect is accused of failing, between 10 April and 19 December 2008, to properly supervise the execution of construction works, despite being obliged under the contract and the Construction Law to handle the property affairs of the Municipality of Głogów, while serving as the construction supervision inspector overseeing the City Hall’s investment involving the construction of Henryka Głogowskiego Street in Głogów, including drainage and lighting, together with the reconstruction of the intersection with Kazimierza Wielkiego Street into a roundabout. This resulted in the approval of invoices issued by the contractor corresponding in monetary terms to the construction of three road layers—the sub-base, binder course and wearing course—provided for in the investor’s cost estimate and the completed bill of quantities, whereas in fact only two layers were constructed—the sub-base and wearing course. This led to the contractor being paid undue remuneration of PLN 589,207 for works that had not been performed and caused significant financial damage to the municipality’s property.

Jan W., questioned as a suspect, did not admit to committing the alleged act and refused to provide explanations. He could face up to 5 years in prison. The prosecutorial proceedings are ongoing.
