The convicted man – 31-year-old Łukasz Sz. – committed the crime together with an acquaintance against his immediate neighbour, solely to obtain money for alcohol.

The indictment in the case concerning the crime committed on 25 October 2015 was filed with the court by the District Prosecutor’s Office in Legnica on 7 January this year. It was established that on the day of the incident, the convicted man and his acquaintance Anna W. drank alcohol together. When it ran out, the woman went to the neighbour and asked him to lend her PLN 5. He refused.

After several minutes, the woman returned together with Łukasz Sz. The victim opened the apartment because he knew her. The convicted man then forced his way inside, hit the victim in the head with his fist and pushed him. He took a telephone and a camera worth PLN 70.

The attackers returned home to continue drinking. After some time, Anna W. offered to return the stolen items to the victim. He opened the door again, and Łukasz Sz. tricked his way inside. The second robbery then took place. The convicted man pushed the man and threatened to kill him. He took a television worth PLN 2,000, a DVD player and two remote controls worth PLN 100.

The pair carried the television to an acquaintance. They received PLN 50 for it. And... returned home to continue drinking.

The victim immediately notified the police about the incident. Officers established where the television was located and returned it to the man who had been attacked. They found the remote controls and the player with the convicted man. Łukasz Sz. was arrested.

It was established that the aforementioned man had previously been convicted by the courts many times, including for burglaries. He left prison on 10 July 2015, that is, three months before the incident.

The convicted man was charged with committing two robberies as a repeat offender. He faced a prison sentence of up to 15 years. The aforementioned man admitted committing the crime, but later withdrew his admission. He denied Anna W.’s involvement in the crime. At trial, however, he apologised to the victim, who did not hold a significant grudge against him.

Taking into account the aforementioned man’s previous convictions, the prosecutor requested a five-year prison sentence and an order to compensate for the damage in the amount of PLN 70. On 23 February this year, the District Court in Legnica found Łukasz Sz. guilty and sentenced him to 2 years and 6 months in prison, granting the request for compensation. The judgment is not final.

The prosecutor requested a written statement of reasons in connection with the sentence being at the lower end of the statutory range. Filing an appeal will be considered.

On 1 March this year, an indictment was also filed with the court against Anna W., who had previously failed to appear when summoned and was therefore wanted and detained for 14 days. The aforementioned woman denies the charges. She had been convicted before, but is not a repeat offender. She faces a sentence of up to 12 years in prison. The case will be heard by a court in Legnica.
