The incident took place on the evening of 28 September 2015 in Szklarska Poręba. That day, at around 9:30 p.m., Marcin G. arrived in his Audi A6 passenger car at one of the guesthouses where Patryk P.
was staying.The two men decided to jointly rob the employees working at a Netto store. They therefore drove together towards Turystyczna Street. On the way, they agreed on the division of roles.
When they arrived, in accordance with their previous arrangements, Patryk P. got out of the car, taking with him an object resembling a firearm, a balaclava, red-and-black gloves and a backpack, and then walked to Netto intending to commit the robbery.
Meanwhile, the other perpetrator parked the vehicle near the store and waited for his accomplice to return. At around 10:10 p.m., suspect Patryk P. knocked on the entrance door of the store’s back room, shouting, “Police!” At that point, P. was already wearing the balaclava, had gloves on his hands and was holding an object resembling a firearm.
The store employee, suspecting nothing, opened the entrance door. The perpetrator then ran inside, shouting at the woman, “This is a robbery!” and, threatening her with the object resembling a firearm, ordered her to take him to where the money was kept.
Fearing for her life, the victim complied. On the way, the perpetrator terrorized two more store employees, threatening to kill them.
After the safe was opened, the employees handed the perpetrator money totalling PLN 9,342.78, including 1,000 20-grosz coins and 3,000 10-grosz coins, which P. ordered them to pack into his backpack.
Patryk P. then fled in the direction where his accomplice was waiting for him, after which they both drove to the guesthouse where Patryk P. had rented a room.
The two men were identified and detained by police officers the very next day, early in the morning. The police also found the balaclava, gloves and backpack containing the stolen coins. The remaining portion of the money taken in the robbery was not recovered.
The perpetrators did not admit to committing the offense with which they were charged. At the prosecutor’s request, pre-trial detention was imposed on them.
Both men had previously been convicted, while Marcin G. had been convicted repeatedly, for offenses against property. They now face up to 12 years in prison.
