The Prosecutor’s Office charged the three with, among other things, committing robbery with the use of a dangerous tool and depriving the victim of his liberty.
The incident took place in the evening hours of 19 May 2015 in Jelenia Góra. At the request of the accused Oliwia W., the victim drove his Mitsubishi Galant to her home.
The aforementioned woman was already waiting there with the two other defendants. All of them got into the vehicle belonging to Michał M. and drove to the railway viaduct in the Zabobrze district. When they arrived, the perpetrators ordered Michał M. to stop the car. The accused Artur W. then got out of the vehicle, opened the driver’s door and struck the victim in the face with a hand wearing a metal knuckle-duster. W. accused M. of stealing PLN 1,500 from the other defendant, Jakub K..
At that point, Oliwia W. handed Michał M. a sheet of paper and ordered him to write a statement saying that he was responsible for stealing PLN 1,500 to Jakub K.’s detriment and that he was handing the car over to the defendants as collateral until the money was repaid. Together with her companions, she also threatened that if he did not do so, they would severely beat him.
Fearing that the threats would be carried out, the victim complied. The perpetrators then ordered M. to move to the back seat, while Artur W. took the wheel. The defendants drove the victim to the vicinity of Miłków and released him there. They abandoned the stolen vehicle in one of the car parks in Jelenia Góra.
The investigation also established that, on the night of 25–26 April 2015, defendant Artur W. was staying with his acquaintances at a club in Jelenia Góra. At one point, the aforementioned individuals went outside the premises. At the same time, Mateusz M. also left the club with his wife and friends. An argument broke out between the groups, during which Artur W. struck Mateusz M. in the head with a telescopic metal baton, causing injuries resulting in a health disorder lasting more than seven days.
Oliwia W., Jakub K. and Artur W. pleaded not guilty to the alleged robbery of Michał M. However, Artur W. admitted to assaulting Mateusz M. on the night of 25–26 April 2015.
At the request of the District Prosecutor in Jelenia Góra, the local District Court ordered pre-trial detention as a preventive measure against all the perpetrators.
All the defendants had previously been convicted, while Artur W. committed the alleged offences under recidivism. The acts they are accused of carry a sentence of between 3 and 15 years’ imprisonment.
