The tragic incident occurred on December 7, 2014, in one of the villages near Lubań. At around 9:00 p.m., the perpetrator returned home, where he lived with his mother. He was intoxicated; earlier, he had drunk half a liter of vodka and two beers. The man began causing a disturbance. At one point, he approached the bed where his mother was lying, grabbed a metal cane and began striking the victim on the head with it. After several blows, the metal object broke. Andrzej G. then grabbed a chair standing nearby and again began striking his mother around the head and neck with such force that the chair also broke.

The perpetrator then telephoned his brother and informed him of what had happened. His brother immediately went to their mother’s home and, when he realized what had happened, called the police and medical assistance. As a result of the blows inflicted by the perpetrator, the victim suffered very extensive injuries to her head and torso. If medical help had not been provided quickly, the woman would have died.

When questioned as a suspect, Andrzej G. did not admit to committing the alleged crime and refused to provide an explanation, claiming that he did not remember the incident because of the extent of his alcohol intoxication.

The aforementioned man was examined by expert psychiatrists, who determined that Andrzej G. was neither mentally ill nor intellectually disabled and that he was legally sane at the time of the alleged offense.

At the request of the District Prosecutor’s Office in Lubań, the court imposed pre-trial detention on the aforementioned man.
The crime with which he was charged carries a sentence of between 8 and 25 years’ imprisonment, or life imprisonment.

Andrzej G. had previously been convicted by a court for offenses against the family and destruction of property.
