The incident occurred on 1 April this year in Bolesławiec. The evidence gathered shows that the accused knew his victim – they had previously lived on the same street and worked at the same establishment. At approximately 8:00 p.m. on the day in question, drunk Grzegorz G. telephoned Tomasz L. and asked him to tell his brother that he wanted to meet him and drink vodka. When the victim refused, the accused began threatening to murder him and hurling vulgar abuse at him. Tomasz L. was not concerned by the threats, however, and went into town with his friends and brother to buy alcohol. They also intended to find the accused in order to explain to him “what exactly his problem was.” They went to his apartment, but he was not there. They encountered him only on Garncarska Street. There, Tomasz L. and Grzegorz G. – attempting to clarify the matter of the telephone conversations – began arguing and then fighting, each striking the other twice in the face. Both fell to the ground. When the accused was lying on his back and the victim was kneeling over him, restraining him with a knee against his abdomen and holding his arms, he stabbed Tomasz L. in the left side of the abdomen with a kitchen knife he had been carrying, previously concealed in his sleeve, with an 18-centimetre blade. As a result of the blow, the knife handle broke off; the blade remained in the wound, while the handle stayed in the accused’s hand. On seeing this, the victim quickly got up and called his friends, who were waiting for him near the park. His friends immediately called an ambulance, which took him to the hospital in Bolesławiec. The victim underwent immediate surgery, during which the knife blade was removed from the wound.

After the incident, the accused went home, throwing away the knife handle on the way, and went to sleep. The next day, he was arrested by the police. Grzegorz G. confirmed that he had grappled with the victim on the day in question, but did not remember whether, when or under what circumstances he had stabbed him. Grzegorz G. was placed in pre-trial detention. The crime with which he is charged carries a sentence of no less than eight years’ imprisonment, 25 years’ imprisonment or life imprisonment.
