The District Prosecutor’s Office charged Tadeusz H. with attempting to induce other people to cause an incident posing a threat to property on a large scale—namely, a fire involving 11 tractor units and 8 tankers, each with a capacity of 36,000 litres and filled with petrol and diesel fuel, located on the premises of one of the properties in Jelenia Góra.

The defendant was also accused of urging Józef K. to find perpetrators who would destroy by arson the cars belonging to the injured parties: an Audi A8 (value: PLN 490,000), a Volvo XC 60 (PLN 100,000) and a Volkswagen Touran (PLN 30,000). However, he did not achieve his intended aim because Józef K. had no intention of committing these acts.

As established, from December 2011 to September 2012, Tadeusz H. repeatedly met Józef K. in Jelenia Góra, Szklarska Poręba and Bolesławiec. During these meetings, the perpetrator repeatedly urged his acquaintance to find people willing to set fire to trucks and fuel-filled tankers located at the depot of one of Jelenia Góra’s companies, as well as vehicles belonging to the company’s owners—the passenger cars listed above.

During these conversations, H. instructed his acquaintance that the arson should be carried out when the tankers were filled with petrol or diesel fuel. He also drove him to the vicinity of the company’s depot, showing him the places where the fires should be started and indicating the arsonists’ escape route.

Józef K. informed the injured parties about Tadeusz H.’s plans. They asked him to record his conversation with the perpetrator during their next meeting. That is what happened.

The investigation also established that Tadeusz H.’s reason for urging his acquaintance to organise people to set fire to the vehicles in question was that the injured parties had given statements implicating Tadeusz H. in another case pending before the Regional Prosecutor’s Office in Zielona Góra.

The perpetrator denied committing the offence until the very end of the trial before the court of first instance. Nevertheless, the court found him guilty of the offence with which he had been charged and sentenced him to three years’ imprisonment.

H. had already been convicted. The judgment is not final.
