The incident took place on January 27 on the A4 motorway near Żarska Wieś (Zgorzelec municipality). Border guards checked the legality of the Ukrainian citizen’s stay. They found that the foreigner was using a work visa contrary to its intended purpose. The man was unable to document that he had begun cooperating with the company that had invited him to Poland.

The officers notified the Ukrainian’s Polish employer. The employer confirmed that, despite the invitation, the man had not contacted his company at all. The officers determined that, using the visa, the foreign national had travelled to Germany and taken up employment there.

The man offered the border guard 50 euros in exchange for abandoning official duties. He was arrested.

The foreigner admitted his guilt and applied for voluntary submission to punishment (one year in prison, suspended for three years). In addition, his visa was revoked, he was ordered to leave Poland, and a three-year ban on entering the countries of the Schengen Area was imposed on him.
