The District Prosecutor’s Office in Jawor has sent an indictment to court against 35-year-old Mateusz K., who, according to investigators’ findings, caused a fatal road accident in the village of Małuszów. The motorcyclist died as a result of the incident. The man will be held responsible for unintentional violation of road safety rules resulting in death.
The tragedy occurred on 20 September 2025, at around 3 p.m., on provincial road no. 320. According to the prosecutor’s office, Mateusz K. was driving a Volkswagen Touran towards Legnica. At one point, he began turning left in order to enter the premises of a petrol station.
Investigators say that the driver failed to exercise due caution and failed to give way to a group of three motorcycles travelling in the opposite direction. As a result, a direct collision occurred with a Kawasaki motorcycle.
The force of the impact was very strong. The motorcyclist was thrown from the vehicle and landed about 50 metres from the collision site. Despite the immediate response of witnesses and attempts to provide first aid, the man could not be saved. He died before the emergency medical team arrived as a result of extensive multiple-organ injuries.
Two other motorcyclists travelling in the same group also took part in the incident. One of them, attempting to avoid the collision, hit the defendant’s vehicle, which had already stopped.
The other made a sudden evasive manoeuvre and drove into a nearby cornfield. Neither was injured.
During the investigation, extensive evidence was secured. It includes, among other things, expert opinions on the reconstruction of road accidents, surveillance recordings and a dashcam recording from a vehicle that captured the moment of the incident.
The experts’ findings show that both the car and the motorcycles were technically roadworthy. The experts also indicated that the dangerous situation was caused by the conduct of the Volkswagen driver, who crossed the path of a motorcyclist travelling correctly.
Mateusz K. was charged with causing a road accident resulting in death. The defendant pleaded not guilty and refused to give explanations.
During the preparatory proceedings, the 35-year-old was subject to preventive measures in the form of Police supervision and a ban on leaving the country. The alleged offence carries a penalty of between 6 months and 8 years’ imprisonment. The case will be heard by the District Court in Jawor.
