The prosecutor’s office has concluded proceedings concerning alcohol being served during the “Future Gala of Szpital św. Łukasza,” held on October 25, 2025, in the sports hall of I Liceum Ogólnokształcącego in Bolesławiec. We wrote about it in the article: Alcohol at a gala in a high school hall. As Prokuratura Okręgowa w Jeleniej Górze informed the istotne.pl portal, the opening of an investigation was refused due to the negligible social harm of the act.
The case concerned an event organized by Fundacja Wspierajmy Zdrowie for employees of Szpital św. Łukasza. Alcohol was served during the event, and the drinks had names referring to medical terminology, including “stat!”, “resuscitation,” “saturation,” “death” and “emergency duty.”
The prosecutor’s office confirmed that there had been a formal violation of the provisions of the Act on Sobriety Education and Counteracting Alcoholism. Under the applicable law, serving alcohol is strictly prohibited on the grounds of public schools. The ban applies not only to the school building, but also to other facilities forming part of its grounds, including sports halls.
At the same time, the prosecutor found that in the circumstances of this case, the legally protected interests—particularly the protection of minors and public order—had not been genuinely threatened.
“The event was a closed gala and took place outside the school’s operating hours, in the evening and at night, and on a day free from classes. Participation in the event was restricted to adults בלבד. The circumstances revealed do not indicate that minors were in any way genuinely exposed to the effects of conduct prohibited under Article 14 of the Act,” prosecutor Ewa Węglarowicz-Makowska, press spokesperson for Prokuratura Okręgowa w Jeleniej Górze, told istotne.pl.
As stated in the justification, no individual or social harm was identified, and the extent of any potential harm was assessed as insignificant. For these reasons, Article 17 § 1, point 3, of the Code of Criminal Procedure was applied, allowing the refusal to initiate proceedings in cases involving negligible social harm caused by the act.
The decision in this case is final. This means that criminal proceedings will not be conducted, despite confirmation that the provisions of the Act on Sobriety Education were violated.
