– On November 28, 2024, the District Prosecutor’s Office in Złotoryja was notified by the current Director of the District Youth Educational Center in Jerzmanice-Zdrój of another recent incident involving violence against a resident at the center. The incident was discovered while reviewing surveillance footage – prosecutor Liliana Łukasiewicz, press spokesperson for the Regional Prosecutor’s Office in Legnica, reports.

She adds: – The prosecutor immediately ordered the recording to be secured and, after analyzing it and questioning the injured minor, a 17-year-old, in the presence of a psychologist, determined that the educator’s conduct met the elements of an offense under Article 157 § 2 of the Criminal Code.

58-year-old Mirosław W. was charged with repeatedly hitting the injured party and pulling him by his clothing on November 18, 2024. The latter sustained bodily injuries resulting in a health disorder lasting less than seven days.

The offense carries a penalty of up to two years in prison.

Spokesperson:

Marcin W. confessed to committing the alleged offense and stated that his conduct was a one-time occurrence, caused by the resident’s inappropriate behavior and also by considerable stress resulting from his workload. He said that he deeply regretted what he had done.

What decision did the investigators make?

Taking into account the low risk of a prison sentence for the alleged offense and the suspect’s attitude—he provided explanations and expressed remorse—the prosecutor decided to apply non-custodial preventive measures. These are:

  • police supervision,
  • a property bond of PLN 6,500,
  • a ban on contacting the residents and employees of the District Youth Educational Center in Jerzmanice-Zdrój in any way and on coming within less than 50 meters of them,
  • suspension from performing official duties at the District Youth Educational Center in Jerzmanice-Zdrój.
