Announcement of an unrestricted written tender for operating a restaurant with the lease of premises located at the Bolesławiec Cultural Centre–International Ceramics Centre, Piłsudskiego Square 1c, 59-700 Bolesławiec

1. Subject of the lease

  1. restaurant premises with equipped kitchen and utility facilities with a total area of 60.80 m2, including a dining room of 137 m2. An outdoor terrace with an area of 100 m2. Shared area – toilets – 54 m2 and cloakroom. The inventory list is attached as Annex 1 to the announcement. The premises plan may be obtained from the secretariat of the Bolesławiec Cultural Centre–International Ceramics Centre (BOK-MCC)
  2. lease period: for a fixed term – 3 years from signing the agreement, with the possibility of extending the agreement.
  3. the premises may be viewed and additional information obtained from Tuesday to Friday between 10:00 and 14:00; please contact the BOK-MCC secretariat on tel. 756442145.

2. Lease conditions – the bidder will be required to:

  1. carry out the task in accordance with the Financial Agreement, “Cultural and Educational Centre in Bolesławiec – Stage I – Construction of the Bolesławiec Cultural Centre–International Ceramics Centre”, financed by the EEA Financial Mechanism, namely: Preservation of Polish ceramic heritage and promotion of the region’s cultural traditions. Accordingly, the Lessee shall use ceramic tableware exclusively from ceramic manufacturers located in Bolesławiec County.
  2. pay rent by the specified deadline, i.e. by the 10th day of each month; the Lessee shall settle charges for electricity, heat, water consumed and sewage discharged separately,
  3. pay utility charges according to sub-meters or proportionally to the occupied area, and install a water sub-meter at their own expense.
  4. conclude agreements with suppliers of water, electricity and waste collection services. The Lessee must provide the Lessor with photocopies of the agreements within one month of their conclusion.
  5. operate the restaurant in accordance with sanitary, occupational health and safety, and fire-safety requirements; maintain order and cleanliness in the restaurant, its back-of-house area and the shared area comprising the toilets and cloakroom,
  6. ensure order and safety on the premises,
  7. cooperate with BOK-MCC in carrying out cultural events
  8. preserve the interior design of the leased premises (any change to the interior décor requires written approval from the director of BOK-MCC or a person authorised by them before implementation),
  9. operate the restaurant in accordance with the proposed character of the premises and the planned scope of catering activity – Annex 2,
  10. organise cultural events, with particular emphasis on promoting Bolesławiec artists – Annex 3
  11. organise and operate a restaurant garden on the terrace from spring to autumn. Wedding receptions, First Communion receptions, wakes, etc. are prohibited.
  12. obtain, at their own expense, licences from ZAiKS and STOART, as well as a licence to sell alcohol, etc.
  13. maintain the premises in proper technical and aesthetic condition, including repairing and replacing worn technical equipment components. Carry out the necessary inspections on the premises required by occupational health and safety and fire-safety regulations. Provide the Lessor with copies of the inspection reports.
  14. insure the premises. Cover the costs of replacing external and internal panes of glass with panes having parameters identical to those installed in accordance with the construction design.
  15. cover the costs of protecting the building after 23:00.

3. Bid selection criteria

  1. proposed net rent in PLN/month – 70%,
  2. description of the proposed character of the premises and planned scope of catering activity (cold and hot dishes and beverages are required) – Annex 2, (specification of the programme) – 20%,
  3. proposed number and nature of events promoting Bolesławiec artists – Annex 3 – 10%. The bidder will be selected by the Tender Committee appointed by the Director of BOK-MCC

4. Contents of bids

A bid submitted in this tender must include:

  1. the company name and details (address, telephone number, NIP tax identification number), or, in the case of individuals, their first and last name and other details,
  2. a current extract from the relevant register or a current certificate of entry in the business activity register, the document must have been issued no earlier than 6 months before the bid submission deadline;
  3. a description of the proposed character of the premises and planned scope of catering activity (cold and hot dishes and beverages are required) – Annex 1 to the bid,
  4. the proposed number and nature of events promoting Bolesławiec artists – Annex 2 to the bid,
  5. a statement that the bidder has read the tender conditions and accepts them without reservations,
  6. the proposed net rent in PLN/month,
  7. a statement confirming that the bidder has familiarised themselves with the technical condition of the premises and the draft lease agreement,
  8. a statement consenting to the processing of the bidder’s personal data to the extent necessary to conduct the tender, while maintaining the principle of transparency of the tender procedure and its results,
  9. the draft lease agreement accepted and initialled by the bidder
    *the rent rate proposed in the submitted bid must be higher than the asking price; submitting a bid containing a proposed gross rent rate lower than the asking price specified by BOK-MCC will result in rejection of the bid. Submitting a bid containing a rent rate equal to the asking price will result in cancellation of the tender. The minimum rent is set at PLN 7,000 + applicable VAT per month. 5. Bid bond

  1. The bid bond is set at PLN 1,000
  2. The bid bond must be paid into the BOK-MCC cash office or to the account
    Bank Zachodni WBK SA, Bolesławiec Branch I
    62 1090 1939 0000 0005 1600 0188 no later than 4 days before the tender.
  3. The bid bond paid by the successful bidder is non-refundable and is credited towards the rent determined as a result of the tender. Bid bonds are returned to the other bidders without interest within 3 days of the announcement of the tender results, in the form in which they were paid.

6. Submission of bids

  1. The deadline for submitting bids is 8 February 2011 at 12:00
  2. The bid must be submitted in a sealed envelope marked: “Bid for operating a restaurant with the lease of premises located at the Bolesławiec Cultural Centre–International Ceramics Centre in Bolesławiec. Do not open before 11 February 2011 at 12:00” and must bear the bidder’s name and address.
  3. Each bidder may submit only one bid.
  4. Bids submitted after the deadline will not be considered by the committee and will be returned unopened.
  5. No changes may be made to bids already submitted.
  6. A copy of proof of payment of the bid bond must be attached to the bid.

8. Opening of bids

  1. Bids will be opened on 11 February 2011 at 12:00 in the room designated for the restaurant at BOK-MCC (ground floor of the building).
  2. After checking and showing that the submitted bids are intact, the Chair of the Tender Committee will announce the names and addresses of the bidders and the rent rates they have proposed.

9. Selection of the bid and announcement of tender results

  1. The Tender Committee will check the bids for formal compliance and evaluate them according to the adopted criteria.
  2. The Chair of the Tender Committee will notify in writing all bidders of the tender result within no more than 3 days of the tender closing.
  3. The organiser reserves the right to close the tender without selecting any of the bids.

7. Conclusion of the agreement

  1. The agreement with the selected bidder will be concluded and the premises handed over no later than 14 days from the date on which the tender is decided. The agreement date may be changed only with the consent of both parties.
  2. A condition for concluding the agreement with the successful bidder is payment of a security deposit equal to three times the monthly rent determined as a result of the tender. The deposit will be returned without interest within one month of the date the premises are vacated, in the form in which it was paid. The deposit will not be returned if the tenant breaches the terms of the agreement.
  3. Failure of a party to appear at the place and time specified in the notice to sign the agreement, refusal to pay the deposit or refusal to take over the premises under a handover report will be deemed withdrawal from the agreement, and the bid bond paid will not be refunded.
  4. If the situation specified in section 7.3 occurs, the agreement may be concluded with the next person who offered the highest rent rate after the successful bidder, provided that this person has not withdrawn their bid bond.
