In the article "Homeless 77-year-old man expelled from a shelter in Bolesławiec. He was sober and paid for his stay" we described the story of Ryszard, a homeless man who, at the beginning of January this year, was escorted out of the PCK Homeless Shelter in Bolesławiec by an intervention group. A PCK employee refused to admit the 77-year-old back to the shelter for the night, despite available places.
In response to our article, a PCK representative explained:
– Mr Ryszard did not undertake outpatient treatment and is ill, said the PCK representative. – And we only admit healthy people. We do not have nurses; we have no way to help an ill person. And it is not because we do not want to. We simply do not have such capabilities.
With the assistance of an intermediary, the homeless man filed a report with the prosecutor’s office concerning the failure to perform duties by public officials employed at PCK in Bolesławiec and GOPS in Warta Bolesławiecka, as well as exposing him to a direct risk of loss of health.
Proceedings in this case were discontinued on 16 June 2023 with respect to the acts under Article 160 § 1 of the Criminal Code – due to the absence of elements of a prohibited act – and Article 231 § 1 of the Criminal Code – due to the absence of elements of a prohibited act. The decision was not appealed and is final.
