STATEMENT

  1. The agreement sent by the city of Wrocław differs significantly from the offer presented by the Municipal Office in December 2022, as well as from the draft agreement proposed by the carriers.
  2. In the agreement sent, the City of Wrocław arbitrarily deleted the provisions concerning the counting of passengers commuting from the metropolitan area, while in its December offer the City of Wrocław undertook to pay for journeys within Wrocław. Thus, it expects carriers to honour their entitlements without any remuneration for the carriers on this account.
  3. The City of Wrocław expects all groups entitled to free travel under a resolution of the city council to be granted this entitlement on railway journeys, but does not recognise the need to co-finance their journeys. We remind you that the scope of free travel on municipal transport was significantly expanded in 2018.
  4. The Wrocław Municipal Office introduced a provision stating that the value of the agreement may increase or decrease, and that such a change may be introduced unilaterally by the city without the need for all parties to amend the agreement. Therefore, the proposal could force railway carriers to honour municipal tickets on their trains for a total amount of, for example, PLN 1 for the entire year.
  5. The agreement sent did not include the provision concerning the securing of financial resources in the city’s Multiannual Financial Forecast. Thus, the Municipality of Wrocław sent a multi-year agreement without a guarantee that it would be covered by financial resources. Moreover, the absence of these provisions may raise doubts as to whether the agreement was properly signed by the Mayor of Wrocław.

We saw for the first time the document signed by Wrocław Mayor Jacek Sutryk. It was sent in paper form, without the possibility of editing it or indicating comments. Apart from substantive differences, it contains a number of technical and legal errors that need to be corrected. In view of the above facts, we inform you that the agreement in the form delivered to Koleje Dolnośląskie S.A. by the Wrocław Municipal Office on 17 March 2023 cannot be accepted by our Company. To confirm the accuracy of the statements made above, we enclose both the agreement in the form proposed by KD (based on the December offer) and the new, substantially modified agreement signed by Wrocław Mayor Jacek Sutryk.
