In the article A 77-year-old homeless man expelled from a shelter in Bolesławiec. He was sober and paid for his stay we described the ordeal of Ryszard, a homeless man who at the beginning of January this year was removed from the Shelter for the Homeless run by PCK in Bolesławiec by an intervention team. The man sat on a bench outside the shelter and began to cry. The police called to assist the homeless man did not place him in the shelter. The officers called an ambulance and left. The paramedics examined the senior and recommended a warm place to sleep. A PCK employee refused to admit the 77-year-old back into the shelter for the night, despite available places.
The injured homeless man, through an intermediary, filed a notification with the prosecutor's office concerning the failure to perform duties by public officials employed at PCK in Bolesławiec and GOPS in Warta Bolesławiecka, as well as exposing him to a direct risk of losing his health. We asked the Prosecutor's Office about the further course of the case.
In response to the inquiry concerning the injured party, Ryszard K., I inform you that the notification was received by the District Prosecutor's Office in Bolesławiec on 20 January 2023.
After questioning the injured party, the prosecutor launched an investigation on 17 February 2023 into exposing Ryszard K. in Bolesławiec on 3 January 2023 to a direct risk of loss of life or serious damage to health by removing him from the Shelter for the Homeless in Bolesławiec run by PCK and failing to provide shelter, as well as into the failure to perform official duties in January 2023 in Warta Bolesławiecka by employees—officials of the Municipal Social Welfare Centre in Warta Bolesławiecka—through refusing to accept an application submitted by Ryszard K. and failing to take action to provide shelter to a person unable to cope independently due to age and health; that is, acts under Article 160 § 2 and Article 231 § 1 of the Criminal Code.
Further actions are being carried out in the case, mainly involving the questioning of witnesses, including members of the injured party's family and employees of the institutions mentioned.
