The District Prosecutor’s Office in Bolesławiec conducted proceedings concerning the suspected misappropriation of shipping containers in Krępnica. Investigators found no indication that the landowners had intended to misappropriate the aforementioned items.
As Sebastian Woźniak, deputy head of the Bolesławiec District Prosecutor’s Office, emphasizes, the prosecutor’s office is not authorized to replace a civil court in this matter. According to the investigators, it is the civil court that should rule on ownership rights.
At the same time, the prosecutor issued a decision ordering that the disputed items be handed over to the sailing associations, since, in the authority’s assessment, it is the sailors who have the stronger claim to ownership.
What happens next? Both decisions of the District Prosecutor’s Office in Bolesławiec are not final, so the parties have the right to file an appeal. If one is submitted, the court will decide the matter. If neither party files an appeal, the property in dispute will go to the sailors.
