In an interview with attorney Wojciech Kasprzyk, we discuss what constitutes an insult and what constitutes defamation, as well as the legal steps that should be taken to punish someone who defames or insults us. Once again, we also remind readers that no one online is anonymous.
The director of the Piarist Order’s school in Bolesławiec found this out when he appeared in court for insults he had anonymously posted on the istotne.pl forum from the school’s phone, targeting Grażyna Hanaf.
– To identify the person insulting us online, I would first advise taking screenshots of these messages – attorney Wojciech Kasprzyk advises. – I would then submit an appropriate letter to the prosecutor’s office requesting that the perpetrator’s IP address be determined. The prosecutor then instructs a police officer to contact the portal where the post appeared and request that the IP address be provided; this makes it possible to identify the author of the post – the lawyer adds.
