We wrote about Ryszard’s case in the article “77-year-old homeless man expelled from a shelter in Bolesławiec. He was sober and paid for his stay”.

Attorney Katarzyna Bachciak-Gorzelak confirms that the son and Ryszard commissioned her to prepare a notification for the Prosecutor’s Office. In accordance with their wishes, she sent the document by email so that Ryszard could print, sign and file it with the Prosecutor’s Office.

When Ryszard’s son contacted our editorial office on January 9, he stated that the document would be filed with the Prosecutor’s Office the following day. This was also the end of his contact with the press.

We received information from the prosecutor’s office that, as of January 20, 2023, at 10:51 a.m., no such notification had been received.

As of today, no complaint has been received by the District Prosecutor’s Office in Bolesławiec against employees of GOPS or PCK in connection with the removal of the homeless person Ryszard […] from PCK in Bolesławiec.

According to unofficial information, the Warta Bolesławiecka Municipal Social Welfare Centre was supposed to arrange for Ryszard to stay at the PCK shelter for homeless people in Bolesławiec until medical examinations determined whether or not he was mentally ill. His further ability to stay at the shelter for homeless people in Bolesławiec depends on this. As PCK employees informed us in the article “PCK responds to the article about a homeless man expelled from the shelter”, the regulations of the PCK shelter in Bolesławiec do not allow homeless men with mental illness who are under the regular care of a psychiatric clinic to be admitted.

We are awaiting confirmation of this information from the Warta Bolesławiecka Municipal Social Welfare Centre.

Since January 3, 2023, Ryszard was reportedly staying at a hotel in Bolesławiec, which he paid for from his own funds or with help from his family.

Update: 24 January 2023

I would like to inform you that on the afternoon of January 20, 2023, a notification from the injured party Ryszard’s representative was received by the Prosecutor’s Office in Bolesławiec by post. It concerned the failure to perform duties by public officials employed at PCK in Bolesławiec and GOPS in Warta Bolesławiecka, as well as exposing the injured party to a direct danger of loss of health, i.e. acts under Article 160 § 1 of the Criminal Code and Article 231 § 1 of the Criminal Code.
