The collision between the police vehicle and the truck was investigated by the District Prosecutor’s Office in Jelenia Góra. As prosecutor Tomasz Czułowski, press spokesperson for the District Prosecutor’s Office in Jelenia Góra, informed us, the proceedings in question were discontinued. The reason? Investigators did establish that the incident was caused by a police officer (failure to yield the right of way). However, under the letter of the law, no accident had occurred. Criminal Code:

Art. 177. § 1. Whoever, even unintentionally violating the safety rules governing land, water or air traffic, unintentionally causes an accident in which another person suffers bodily injuries specified in Article 157 § 1 shall be subject to imprisonment for up to 3 years.

§ 2. If the consequence of the accident is the death of another person or serious harm to their health, the perpetrator shall be subject to imprisonment for between 6 months and 8 years.

§ 3. If the injured party is exclusively a close relative, prosecution of the offence specified in § 1 shall take place upon their request.

In this case, only the perpetrator himself suffered injuries lasting more than seven days, so formally it was a collision (a misdemeanour, not a criminal offence). Therefore, in October—after obtaining an expert opinion—the prosecutor’s office had to discontinue the proceedings.

However, as we have established, the entire case is being investigated by the Police Internal Affairs Bureau.

Let us recall. The incident occurred on Saturday, 28 May, after 11:20 a.m. On DK 94, near the economic zone in Wykroty, two vehicles collided: a truck and a passenger BMW (police officers from the SPEED group).

The driver who was passing by told us at the time that the situation looked as though the truck was pulling out of a discount fuel station and the passenger car hit it.

Two police officers from the SPEED pursuit group were taken to hospital.

– As a result of an incident involving a truck and an unmarked police car, two officers were taken to hospital. Fortunately, nothing happened to the TIR driver. Police officers are working at the scene to clarify the circumstances of the incident in detail. As always in cases of this type, the activities are carried out under the supervision of a prosecutor. None of the police officers is in serious condition – said Anna Kublik-Rościszewska of the Bolesławiec police.
