The accident involving a fire engine and a passenger car occurred more than two years ago in Bolesławiec, at the intersection of Cieszkowskiego and Staszica streets. Three people—two adults and a child—were traveling in the passenger car bearing Bolesławiec registration plates. The fire engine driver was traveling along Cieszkowskiego Street and entered the intersection against a red light, where traffic was controlled by traffic signals. The court found that the firefighter had failed to exercise particular caution by increasing his attention and adapting his conduct as a road user to the changing conditions and circumstances on the road, as a result of which he caused a collision with the Volvo entering the intersection from Staszica Street on a green light.

The Volvo driver was injured in the accident. The man suffered a number of bodily injuries, including fractures of the pelvis and ribs, a ruptured urinary bladder and a left-sided pneumothorax. The firefighters’ vehicle and the passenger car were damaged beyond being roadworthy. The firefighters were not injured in the incident.

In a ruling concerning the unintentional violation of a road traffic safety rule and unintentionally causing an accident, the firefighter was required to provide financial compensation to the injured party for the harm suffered and cover court costs. The court conditionally discontinued the criminal proceedings against the firefighter for a one-year probation period. The verdict is final.
