The issue of liability for the damage and the repair of the gravestones caused by the fallen tree is currently being investigated and reported to the insurer.

– Families whose gravestones were damaged should pursue claims with the insurance companies from which they purchased policies – informs Iwona Plizga. – If no policy was purchased, after contacting the site manager, the applications will be forwarded to the manager’s insurer – adds the head of the Cemetery Administration Department.

The fallen tree damaged 13 gravestones. According to the cemetery manager, the incident occurred on a day when IMGW-PIB issued a first-level warning about strong winds for May 1–2. The red oak, which was uprooted by the strong wind, showed no visible signs of disease and had not been designated for removal. Trees at the municipal cemetery are inspected regularly, and trees in poor sanitary condition are removed. In such cases, the repair of damage is governed by the regulations attached to a 2017 resolution of the City Council.

According to the Regulations for the Use of the Municipal Cemetery in Bolesławiec at Śluzowa Street, constituting an attachment to Resolution No. XLI/410/2017 of the Bolesławiec City Council of November 29, 2017, on the rules and procedure for using the Municipal Cemetery in Bolesławiec at Śluzowa Street: § 4. The responsibility for maintaining cleanliness and order at the grave and in its surroundings, as well as securing or insuring the elements of the gravestone, rests with the person caring for the grave, hereinafter referred to as the grave holder.
