Bolesławiec City Hall reminds that every entity conducting business activity is obliged to sign an individual contract for the provision of municipal waste collection services with a company entered in the register of regulated activities, which is available on the Public Information Bulletin website of the Bolesławiec Municipality (https://www.um.boleslawiec.bip-gov.pl/public/?id=100687).
This contract must be concluded in writing.
Non-residential properties where municipal waste is generated include, among others: schools, nursery schools, offices, community centres, libraries, healthcare centres, pharmacies, production, service and commercial facilities, workshops, offices, shops, etc.
Mixing household municipal waste with waste generated as a result of business activity is prohibited.
Inspections of contracts concluded in connection with business activity
As part of inspections conducted under the Act of 13 September 1996 on maintaining cleanliness and order in municipalities, owners of non-residential properties will be required, within 14 days of receiving the notice, to submit copies of current contracts and proof of payment for the service.
Failure to have current contracts for municipal waste collection will result in:
- the initiation of proceedings ordering the fulfilment of this obligation by administrative decision, pursuant to Article 5(7) of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2020, item 1439, as amended);
- the imposition of a fine pursuant to Article 10(2) of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2020, item 1439, as amended).
Pursuant to Article 10(3) of the aforementioned Act, proceedings in the matters referred to in paragraphs 1 and 2 are conducted in accordance with the provisions of the Code of Procedure in Misdemeanor Cases.
