Before Christmas, an order-of-payment judgment (that is, one issued on the basis of the case files) was handed down against councillor Dariusz F.
Investigators accused him of abusing an employee and inciting the commission of the crime of forging a signature. The prosecutor’s office lodged an objection to the judgment, as we reported today. It turns out that councillor Dariusz F. has also lodged an objection.
Below, we publish the statement that the councillor sent to our editorial office.
STATEMENT
I hereby inform you that, through the law firm representing me, I lodged an objection on 4 January 2021 against the order-of-payment judgment in my case. I inform you that to date I have not had the opportunity to make a personal statement before the District Court in Bolesławiec.
In connection with the publication on your portal of the article “The prosecutor’s office wants a harsher sentence for Dariusz F. The councillor will face court again”, I wish to inform you that, in my opinion, the indictment submitted to the District Court in Bolesławiec has no basis and that, under the law, until a final court judgment is issued I am a person with no criminal record, let alone a convicted person.
Therefore, I ask you to refrain from further publications and comments about me until the court proceedings have concluded and a final judgment has been issued. The publications to date on this subject create the impression in public opinion that I am a convicted person and that there is no doubt about my guilt, which is obviously untrue. I also inform you that until the case has concluded, I will not comment on any articles on this subject. I ask that you respect my request also because of the period of mourning following the death of my late Mother.
Since the parties to the proceedings have lodged objections, the case will essentially be heard from the beginning, under the ordinary procedure.
It is not yet known whether the court’s next judgment will be harsher and whether the councillor will lose his mandate.
