Councillors will receive two draft resolutions concerning the choice of method for determining the fee for municipal waste management and setting its rates in Bolesławiec.
One method for determining the municipal waste management fee for properties where residents live is based on multiplying the number of residents living at a given property by a rate of PLN 30.00 for each person living at that property.
The draft also provides for an increased rate of PLN 60.00 for each person living at the property if the property owner fails to fulfil the obligation to collect municipal waste selectively.
The draft also provides for a partial exemption from the municipal waste management fee for owners of properties with detached residential buildings who compost biodegradable municipal waste in a home composter, proportionally to the reduction in the costs of managing household waste, i.e. PLN 1.00 per resident.
The second method includes a differentiated municipal waste management fee for a property where residents live, depending on the number of residents:
- 1 person – PLN 36.00,
- 2 people – PLN 36.00 per resident,
- 3 people – PLN 33.00 per resident,
- 4 people – PLN 29.00 per resident,
- 5 people – PLN 27.00 per resident,
- 6 people or more – PLN 24.00 per resident.
An increased municipal waste management fee is provided for if the property owner fails to fulfil the obligation to collect municipal waste selectively, for properties with:
- 1 person – PLN 72,
- 2 people – PLN 72.00 per resident,
- 3 people – PLN 66.00 per resident,
- 4 people – PLN 58.00 per resident,
- 5 people – PLN 54.00 per resident,
- 6 people or more – PLN 48.00 per resident.
The draft also provides for a partial exemption from the municipal waste management fee for owners of properties with detached residential buildings who compost biodegradable municipal waste in a home composter, proportionally to the reduction in the costs of managing household waste, i.e. PLN 1.00 per resident.

The justification for adopting the resolution is that, in Article 6r(1aa) of the Act of 13 September 1996 on Maintaining Cleanliness and Order in Municipalities (Journal of Laws of 2020, item 1439), the legislator clearly stated that funds from the municipal waste management fee may not be used for purposes unrelated to covering the operating costs of the municipal waste management system. Article 6r(2) of the aforementioned Act provides that the municipality covers, from the collected fees, the operating costs of the municipal waste management system, including the costs of collecting, transporting, recovering and disposing of municipal waste; establishing and maintaining selective municipal waste collection points; administrative support for the system; and environmental education concerning the proper handling of municipal waste.
The municipality also covers, from the collected fees, the costs of equipping properties with containers for collecting municipal waste; maintaining containers in an appropriate sanitary, orderly and technical condition; removing municipal waste from places not intended for its disposal or storage; accepting waste at selective municipal waste collection points; and ensuring that this waste is accepted.
It adds:
In Bolesławiec, in the years 2013–2018, revenue from the municipal waste management fee fully covered expenditure on operating the municipal waste management system. In 2019, expenditure exceeded revenue by PLN 2,172,250.01. Consequently, to ensure the efficient operation of the waste management system, it became necessary to recalculate the municipal waste management fee. Bringing the fee and system operating costs into balance requires adjusting the municipal waste management fee to a realistic level. The proposed municipal waste management rates are similar to those in other cities.
