The lawmakers had a noble goal when creating the provision on counteracting food waste, but in practice they did not anticipate that large stores would have trouble finding a non-governmental organization for which collecting free food and passing it on to those in need would be financially worthwhile.
No local non-governmental organization has come forward to collect free food from Carrefour. The hypermarket signed an agreement with the Legnica branch of Caritas, but Legnica is too far away to travel to Bolesławiec for food. Non-governmental organizations must also be mindful of costs such as fuel and the driver's work. The hypermarket has an agreement in accordance with the law, but is forced to throw away unusable food products.
Let us recall that the aim of the Act of 19 July 2019 on counteracting food waste (Journal of Laws of 2019, item 1680; hereinafter: the Act on Counteracting Food Waste) was to create a system for the free transfer of unusable food products by stores and wholesalers with an area larger than 400 sq m. Food products including those with a short use-by period or minimum durability date, as well as those with defects in appearance or packaging, are to be collected by public benefit organizations. The purpose was to prevent food waste and ensure that supermarkets would not have to throw still-good products into the bin.
The management of the Carrefour hypermarket appeals to non-governmental organizations from Bolesławiec and the surrounding area to come forward to collect food.
