The incident occurred on Monday, August 31, before 1:00 p.m., on Dolne Młyny Street in Bolesławiec. Two men from Jelenia Góra County, suspecting that the driver of a Nissan was intoxicated, detained him and notified the police.

The community police officers who arrived at the scene determined that, after seeing a staggering man getting out from behind the wheel of the vehicle, the two residents of Jelenia Góra County took his keys away, preventing him from driving on. The police officers called to the scene confirmed that the detained man was intoxicated.
The informants' suspicions were confirmed. The 41-year-old Nissan driver, a resident of Nowogrodziec municipality, had nearly 2.5 promille of alcohol in his system. Moreover, it emerged that his driving privileges had been revoked.
The 41-year-old, who was taken to a police cell, could now face up to two years in prison.

As stated in the Code of Criminal Procedure:
Art. 243. § 1. Everyone has the right to detain a person caught in the act of committing an offence or in pursuit undertaken immediately after the commission of an offence, if there is a concern that the person may go into hiding or if it is impossible to establish their identity.
§ 2. A detained person must be handed over to the Police without delay.
