We reported on the case in detail in May in the article: Police officer arrested over bribes. Bolesławiec prosecutor’s office has already questioned him.

On 28 July, the Bolesławiec District Prosecutor’s Office filed an indictment with the District Court in Lwówek Śląski against police officer Marcin S. The man is accused of:

  • accepting a financial benefit of EUR 200 in exchange for acting as an intermediary in arranging the shortening of quarantine in connection with the COVID-19 epidemic, i.e. an act under Article 228 § 3 of the Penal Code and Article 230 § 1 of the Penal Code in conjunction with Article 11 § 2 of the Penal Code, punishable by imprisonment from one to 10 years
  • certifying an untruth in a document of significant legal importance, namely notes concerning the obligation to monitor quarantine, while the perpetrator acted to obtain a financial benefit, i.e. an act under Article 271 § 3 in conjunction with § 1 of the Penal Code and Article 231 § 2 in conjunction with Article 11 § 2 in conjunction with Article 12 § 1 of the Penal Code, punishable by imprisonment from one to 10 years
  • demanding the acceptance of a financial benefit of PLN 1,500 in exchange for not notifying the relevant services that a person under quarantine had changed their place of residence, i.e. an act under Article 228 § 4 of the Penal Code and Article 230 § 1 of the Penal Code in conjunction with Article 11 § 2 of the Penal Code, punishable by imprisonment from one to 10 years
  • causing a lending company to disadvantageously dispose of its property in connection with taking out a PLN 450 loan in 2014 and misleading the injured party as to the intention to repay it, i.e. an act under Article 286 § 1 of the Penal Code, punishable by imprisonment from six months to eight years
  • and disclosing to an unauthorized person information obtained in connection with official duties—the information concerned the deployment of police patrols in Lwówek County on 31 December 2019–1 January 2020, i.e. an act under Article 266 § 2 and Article 231 § 1 of the Penal Code in conjunction with Article 11 § 2 of the Penal Code, punishable by imprisonment of up to three years.

The suspect fully admitted to the charges brought against him and gave explanations. A motion was filed regarding the suspect’s voluntary submission to punishment under Article 335 § 2 of the Code of Criminal Procedure.

On 13 August, the preventive measure of temporary detention applied to the suspect was extended by the District Court in Lwówek Śląski for one month, i.e. until 17 September 2020.
