On June 26, 2019, the Bolesławiec City Council adopted a resolution granting President Piotr Roman discharge for the implementation of the 2018 budget. The councillors adopted the resolution after first reviewing the submitted “Report on the state of the city of Bolesławiec” for 2018 and holding a debate on the subject. The report is a source of information about the activities of the municipal government, Bolesławiec and changes taking place in areas of residents’ activity.
The report was prepared on the basis of materials from the departments of the Bolesławiec City Office, municipal organizational units and companies in which the Municipality of Bolesławiec holds shares. The report contains annual data on individual areas of the city’s functioning, thereby reflecting the activities of the municipal government and the development of Bolesławiec.
The discharge was also preceded by granting a vote of confidence to the President of Bolesławiec, as well as reports, opinions and positions of councillors’ groups:
- the report on the implementation of the city budget for 2018 and the financial statements
- the opinion of the Regional Chamber of Audit in Wrocław on the report on the implementation of the city budget for 2018 submitted by the President of Bolesławiec, and information on the state of municipal property
- the opinion of the Audit Committee of the City Council
- the opinion of the Regional Chamber of Audit in Wrocław on the application of the Audit Committee of the Bolesławiec City Council concerning the granting of discharge to the President of Bolesławiec for 2018
- the positions of councillors’ groups.
The Regional Chamber of Audit issued a positive opinion on the report on the implementation of the 2018 budget submitted by the president. When making changes to the budget resolution, the President of Bolesławiec acted within the limits of the authorizations granted by the City Council and his own powers arising from the applicable regulations. The opinion of the Audit Committee is also positive. In implementing the budget, the President of Bolesławiec followed the principles set out in the chapter “Principles of managing public funds” of the Public Finance Act:
- he observed the prohibition on transferring public funds originating from individual sources to finance specifically named expenditures (the budget covers all revenues collected as well as expenditures and outgoings made)
- he applied the principles of universality and equality in access to the performance of public tasks (e.g. granting subsidies from the budget to various entities regardless of their sectoral affiliation—public or non-public)
- he spent public funds in accordance with the objectives and maximum limits established in the budget resolution and the financial plan, in a purposeful, economical and effective manner, observing the principles of legality, reliability, openness and transparency
- he incurred liabilities in accordance with the amounts established in the 2018 expenditure plan and the authorizations granted by the City Council
- he allocated public funds for the performance of tasks while preparing offers that did not display characteristics of unfair competition (regardless of the status of the entity applying for public funds)
- he placed surplus funds in bank accounts outside the bank handling the city’s banking services, obtaining more favorable terms
- he granted relief concerning monetary receivables in accordance with the applicable regulations (Code of Administrative Procedure, Tax Ordinance, resolutions of the Bolesławiec City Council).
Seventeen councillors voted to grant discharge to President Piotr Roman, with no votes against and four abstentions. The discharge was preceded by the adoption of a resolution approving the financial statements together with the report on the implementation of the city budget for 2018.
