In April this year, Mariusz Ch., former head of the neurology department at the Hospital for the Nervously and Mentally Ill, was sentenced by the District Court in Jelenia Góra to two years in prison, suspended for five years, a fine of PLN 108,000, and a three-year ban on practising his profession. It was known that an appeal would be filed. At that time, the prosecutor was already seeking three and a half years of unconditional imprisonment for the doctor. Let us recall: the man from Bolesławiec was convicted of corruption and certifying false information in documents.
The Court of Appeal in Wrocław issued a more lenient judgment. The fact that the man from Bolesławiec had not previously been convicted, as well as the excellent opinions regarding his professional qualifications, were taken into account. The total amount of the bribe accepted by Mariusz Ch., namely PLN 1,600, was also significant. The charge of falsifying documents was also dismissed (it was determined that the medical certificates he issued were truthful). Consequently, Wrocław judge Grzegorz Kapera lifted the ban on practising his profession.
Mariusz Ch. may practise medicine again, but for three years he will not be allowed to hold a managerial position in the healthcare service. The Court of Appeal also reduced the prison sentence. The man from Bolesławiec was sentenced to one year and eight months in prison, suspended. He will also have to pay the fine imposed earlier. The judgment is final.
