Andrzej Chodyra was first appointed temporary head of the Bolesławiec Water and Sewerage Company on 5 July 2006. Initially, he was to serve in this role until 5 January 2007. By that time, the company’s director was supposed to be selected through a competition. However, things turned out differently. On 5 January, the voivode once again appointed Chodyra temporary head of PWiK.

According to PWiK’s former director, Józef Burniak, the voivode’s decision was unlawful. The former mayor of Bolesławiec notified the Wrocław Regional Prosecutor’s Office of the matter. The company’s Works Council, which also opposed Andrzej Chodyra’s reappointment, filed a lawsuit with the Economic Court in Jelenia Góra.

Although the Jelenia Góra court ruled in favor of PWiK employees, this did not stop Andrzej Chodyra from dismissing his deputy, Piotr Hodowany, on disciplinary grounds. “The law says that the deputy and the chief accountant may be dismissed only by the director with the consent of the Works Council. No one informed us of this or asked for our consent,” Beata Raczyńska-Rzemek, Secretary of the PWiK Works Council, told the Boleslawiec.org portal at the time. Krzysztof Grzelczyk appealed the ruling and... appointed Chodyra temporary head of the Bolesławiec company for the third time.

On 26 June, the Wrocław Court of Appeal issued its ruling. By overturning the voivode’s decision, the Wrocław court once again ruled in favor of employees of the Bolesławiec Water and Sewerage Company. Andrzej Chodyra will no longer work at PWiK, as the Court of Appeal’s ruling is not subject to cassation appeal. “It turns out that we live in a state governed by the rule of law,” Beata Raczyńska-Rzemek told us today. A lawful competition for the position of director will be announced soon. The Secretary does not yet know whether PWiK will seek compensation. “This matter will certainly not go unnoticed,” Beata Raczyńska-Rzemek added.
