The woman, who initially denied committing the acts of which she was accused, decided to enter into a so-called court settlement. She was sentenced, among other things, to a ban on holding the positions of management board chairwoman, commercial proxy, management board member and liquidator in housing cooperatives and commercial-law companies. She must also pay a total fine of PLN 7,200 and legal costs amounting to PLN 10,000.
The above-mentioned woman was accused of violating the employee rights of 196 people, failing to declare bankruptcy on time, and violating the provisions of the Accounting Act and cooperative law.
Failure to declare bankruptcy on time
Accepting the version most favorable to the accused, the prosecutor determined that bankruptcy should have been declared between March 31 and October 14, 2013. It was then that the court discontinued the bankruptcy proceedings because the cooperative had no assets.
Violation of employee rights
From January 2011 to April 10, 2015—that is, for more than four years—the accused persistently and maliciously violated employees’ rights arising from their employment and social insurance relationships, as she failed to pay or paid late amounts due in wages and failed to remit the required social and health insurance contributions. Some employees have still not received their wages, sometimes amounting to several thousand zlotys.
Charges and refusal to provide explanations
Danuta S. was charged with the offenses mentioned above. The above-mentioned woman was questioned several times as a suspect, but did not admit to committing the alleged acts and exercised her right to refuse to provide explanations.
Verdict of June 23 this year
The case was heard by the Legnica District Court after the Legnica district prosecutor filed an indictment in June 2015. The verdict is not final. The prosecutor considered it justified, which means that he does not intend to lodge an appeal.
