During the investigation, it was established that Dariusz P. had narcotic substances weighing 344.91 g in an apartment on Sygietyńskiego Street in Jelenia Góra on December 18, 2015. An electronic scale and a wooden grinder for grinding dried plant material were also found in the room occupied by P.

Questioned as a suspect, Dariusz P. admitted committing the alleged offense and explained that he possessed the narcotic substances for personal use. He added that he had purchased them from an unknown man in Jelenia Góra.

Due to doubts concerning his mental health, expert psychiatrists were appointed. The forensic psychiatric opinion concluded that Dariusz P. was legally sane at the time of the offense.

The prosecutor filed a motion to refer the case for consideration at a hearing, issue a conviction, and impose the sentence agreed with Dariusz P.:

  • one year of imprisonment, suspended for three years
  • a PLN 1,500 fine
  • a payment to an anti-drug-fighting fund (PLN 2,000)
  • supervision by a court-appointed probation officer
  • an obligation to continue his education and refrain from using narcotic substances and abusing alcohol
  • forfeiture of the narcotic substances and items used to commit the offense.

As part of the investigation, P. was also charged with purchasing marijuana in the Czech Republic in December 2015 and transporting it to Poland. However, the materials concerning this act were separated into a separate proceeding, and on June 7 a decision was made to discontinue the proceeding due to the absence of the elements of an offense.
